§ 50.999 PENALTY.
   (A)   Any user who is found to have violated an order of the Director or who has failed to comply with any provision of this chapter, and the regulations, or rules of the city, or orders of any court of competent jurisdiction, may be subjected to the imposition of a civil penalty. Except as otherwise provided, any person, firm of corporation violating any provision of this chapter shall be fined an amount not to exceed $1,000 per day per violation. A separate offense shall be deemed committed each day during or on which the offense occurs or continues. After the second conviction, the city may discontinue the service of the sewage and disposal system to the violator. The violator is liable for actual damages incurred by the POTW per violation per day for as long as the violation continues. In addition to the above described penalty and damages, the Director may recover reasonable attorney's fees, court costs and other expenses associated with the enforcement activities, including sampling and monitoring expenses.
   (B)   Any person who willfully or negligently violates any provisions of this chapter or any order or permits issued hereunder shall, upon conviction, be guilty of a misdemeanor, punishable by a fine not to exceed $1,000 per violation per day or imprisonment for not more than six months, or by both. In the event of a second conviction, the person may be punished by a fine not to exceed $3,000 per violation per day or imprisonment for not more than three years, or both.
   (C)   Any industrial use who willfully or negligently violates any provision of this chapter or any orders or permits issued hereunder shall be punished by the imposition of a fine not to exceed $1,000 per violation per day or imprisonment for not more than six months, or by both. In the event of a second conviction, the use shall be punished by a fine not to exceed $3,000 per violation per day or imprisonment for not more than three years, or both.
