The emission within the City of smoke, the density of which is equal to or greater than number one of the Ringelmann Chart, published by the Bureau of Mines, U.S. Department of Interior, from any device or equipment, other than incinerators, smokestack or chimney of any building, excepting for five minutes in any one hour, during which time the fire box is cleaned out or a new fire is being built therein, is declared to be a nuisance and may be summarily abated by any member of the Police Department or the Fire Department, in addition to the prosecution and fine provided for in this chapter.
