1302.18 CONVERSION NOTICE TO CITY; REVIEW; FEE.
   No apartment house or multiple family use in the City shall be converted into a condominium by the sale of individual suites to owners under this chapter until and unless the owner shall first have complied with the following regulations, and no certificate of occupancy shall be given to any purchaser of a condominium unit until the apartment house owner converting to condominium has fully complied herewith:
   (a)   The owner shall notify the Building Department, Council and each tenant, of the owner's intention to convert to condominium units, and the Planning and Zoning Commission shall inquire whether any violations of the Planning and Zoning Code exist upon the premises, whether any variances have been granted for the premises, whether the Building Code, Fire Code and other applicable laws are being complied with, and review and approve any proposed amendment to the site development plan as well as the site development plan. The Commission, prior to its approval, shall further obtain a sewer evaluation study, including both storm and sanitary sewers from the City Engineer, which shall indicate the effect of the proposed conversion development upon the existing sewer system and may require, as circumstances indicate, a retention basin(s). The Commission shall further require compliance with Sections 1302.19, 1302.20 and 1302.21 prior to rendering its approval. The Commission shall further obtain reports from the Police and Fire Departments concerning the proposed condominium conversion development prior to its approval.
   (b)   Any variance granted to property for which an application for condominium conversion has been filed which has been granted to an apartment house or multi-family use, referred to in this chapter, the recommendation of the Board of Zoning and Building Appeals is hereby declared void and not transferable to the condominium buyers, unless the Board of Zoning and Building Appeals, after study of the proposed usage, shall approve the variance or any modification thereof for the proposed conversion condominium use.
   (c)   The notice of the City in subsection (a) hereof shall be by written application, together with a deposit of fifty dollars ($50.00) per suite to reimburse the City for its cost incurred in the review of the application and for the inspections required by Section 1302.06.
