12-1-3: HOW TO USE THIS CHAPTER:
   A.   The building commissioner shall be responsible for fulfilling all of the duties listed in section 12-1-4 of this chapter.
   B.   To fulfill those duties, the building commissioner first should use the criteria listed in section 12-1-5, "Base Flood Elevation", of this chapter to determine whether the development site is located within a floodplain.
Once it has been determined that a site is located within a floodplain, the building commissioner must determine whether the development site is within a flood fringe, a designated floodway, or within an SFHA or floodplain for which no floodway has been identified.
      1.   If the site is within a flood fringe, the building commissioner shall require that the minimum requirements of section 12-1-6 of this chapter be met.
      2.   If the site is within a floodway, the building commissioner shall require that the minimum requirements of section 12-1-7 of this chapter be met.
      3.   If the site is located within an SFHA or floodplain for which no detailed study has been completed and approved, the building commissioner shall require that the minimum requirements of section 12-1-8 of this chapter be met.
   C.   In addition, the general requirements of section 12-1-9 of this chapter shall be met for all developments meeting the requirements of section 12-1-6, 12-1-7, or 12-1-8 of this chapter.
   D.   The building commissioner shall assure that all subdivision proposals shall meet the requirements of section 12-1-10 of this chapter.
   E.   If a variance is to be granted for a proposal, the building commissioner shall review the requirements of section 12-1-11 of this chapter to make sure they are met. In addition, the building commissioner shall complete all notification requirements.
   F.   In order to assure that property owners obtain permits as required in this chapter, the building commissioner may take any and all actions as outlined in section 12-1-13 of this chapter. (Ord. 2005-11, 5-16-2005)
