10-2-1: RULES AND INTERPRETATION:
The following rules shall apply for construing or interpreting the terms and provisions of this title:
   A.   The words "shall", "must", and "will", are mandatory in nature, establishing an obligation or duty to comply with the particular provision. The word "may" is permissive in nature. Words used in the present tense include the future tense. Words used in the singular number include the plural number and the plural number includes the singular number, unless the context of the particular usage clearly indicates otherwise. Words used in the masculine gender include the feminine gender. The term person includes individual, firm, partnership, association, corporation, company, organization, or partnership, singular or plural, of any kind.
   B.   In their application, the provisions of this title shall be the minimum requirements for the promotion and protection of the public health, safety, morals and general welfare, and shall be construed to achieve the purposes for which this title is adopted.
   C.   This title is not intended to abrogate any easement, covenant, or other private agreement. However, where the regulations of this title are more restrictive or impose higher standards or requirements than such easement, covenant, or other private agreement, the requirements of this title shall govern.
   D.   In the event of a conflict between the text of this title and any caption, figure, illustration, table, or map contained herein, the text shall control.
   E.   In their interpretation and application, the provisions of this title shall be held to be the minimum requirements for the promotion of the public health, safety, morals and welfare.
   F.   When a use is not specifically listed in the sections devoted to permitted uses, it shall be assumed that such uses are hereby expressly prohibited. However, such uses may then be permitted by a written decision of the zoning administrator stating that said use is similar to and not more objectionable than uses listed.
   G.   No building, structure, or use which was not lawfully existing at the time of the adoption of this title shall become or be made lawful solely by reason of the adoption of this title. To the extent, and in any matter that said unlawful building, structure, or use is in conflict with the requirements of this title, said building, structure, or use remains unlawful hereunder.
   H.   The provisions of this title are cumulative and are additional limitations upon all other laws and ordinances adopted prior to the effective date hereof, or which may be passed hereafter governing any subject matter in this title. (Ord. 2001-08A, 4-2-2001)
