8-4-2-1: CROSS-CONNECTION CONTROL:
   A.   Application: These rules and regulations shall apply to all premises served by the public potable water supply system of the Village.
   B.   Definitions: The following definitions shall apply in the interpretation and enforcement of these regulations:
AGENCY:
Illinois Environmental Protection Agency (the "IEPA").
APPROVED BACKFLOW PREVENTION DEVICES:
Backflow prevention devices or methods approved by the Research Foundation For Cross-Connection Control of the University Of Southern California, Association Of State Sanitary Engineers, http://www.usc.edu/dept/fccchr/, American Water Works Association, www.awwa.org, American National Standards Institute, www.ansi.org, or certified by the National Sanitation Foundation, www.nsf.org, or listed in the Illinois plumbing code or any other codes adopted by the Village.
AUXILIARY WATER SYSTEM:
Any water source or system on or available to the premises other than the public water supply system and includes the water supplied by the system. These auxiliary waters may include water from another purveyor's public water supply system; or water from a source such as wells, lakes, or streams, or process fluids; or used water. These waters may be polluted or contaminated or objectionable or constitute a water source or system over which the water purveyor does not have control.
BACKFLOW:
The flow of water or other liquids, mixtures, or substances into the distribution pipes of a potable water system from any source other than the intended source of the potable water supply.
BACKFLOW PREVENTION DEVICE:
Any device, method, or type of construction intended to prevent backflow into a potable water system. All devices used for backflow prevention in Illinois must meet the standards of the Illinois plumbing code, the American Society of Sanitary Engineering ("ASSE"), and the Illinois Environmental Protection Agency.
CONTAMINATION:
An impairment of the quality of the water by entrance of any substance to a degree which could create a health hazard.
CROSS-CONNECTION:
Any physical connection or arrangement between two (2) otherwise separate piping systems, one of which contains potable water and the other a substance of unknown or questionable safety or quality, whereby there may be a flow from one system into the other.
CROSS-CONNECTION CONTROL BY CONTAINMENT:
The installation of a backflow prevention device at the service connection to a premises to protect the water main.
CROSS-CONNECTION CONTROL BY ISOLATION:
The installation of a backflow prevention device at each cross-connection in a premises to protect both the premises and water main.
CROSS-CONNECTION CONTROL DEVICE INSPECTOR (CCCDI):
A plumber who holds an Illinois plumbing license and who has been certified by the IEPA, or any other required agencies, to inspect, test, maintain and repair cross-connection control devices. Such certification attests to an inspector's understanding of the principles of backflow and back siphonage, and the public health hazard presented by the improper installation of cross-connection control devices. A CCCDI who works in the Village must on a yearly basis be registered in the Village and must submit and have on file with the Village their current agency approval number and Illinois plumbing license for the time period when they are operating in the Village.
Any contractor performing cross-control device inspection services shall provide the following information and/or documentation:
   1.   A copy of the plumber license for each plumber performing cross-connection inspections.
   2.   A copy of the contractor's current plumbing contractor's license.
   3.   A copy of the current CCCDI license for each inspector.
   4.   A copy of the contractor's annual certification and calibration for each test kit.
CUSTOMER:
The owner, official custodian, tenant, or person in control of any premises supplied by or in any manner connected to a public water system.
CUSTOMER'S WATER SYSTEM:
Any water system located on the customer's premises. A building plumbing system is considered to be a customer's water system.
DIRECT CROSS-CONNECTION:
A cross-connection formed when a water system is physically joined to a source of unknown or unsafe substance.
DOUBLE CHECK VALVE ASSEMBLY:
An assembly composed of single, independently acting check valves approved under American Society of Safety Engineers ("ASSE") standard 1015. A double check valve assembly must include tight shutoff valves located at each end of the assembly and suitable connections for testing the water-tightness of each check valve.
FIXED PROPER AIR GAP:
The unobstructed vertical distance through the free atmosphere between the water discharge point and the flood level rim of the receptacle.
HEALTH HAZARD:
Any condition, device or practice in a water system or its operation resulting from a real or potential danger to the health and well-being of customers. The phrase "high hazard" as used to qualify "health hazard" means a hazard to the health of the user that could be expected to result in death or significant reduction in the quality of life.
INDIRECT CROSS-CONNECTION:
A cross-connection through which an unknown substance can be forced, drawn by vacuum or otherwise introduced into a safe potable water system.
INSPECTION:
A plumbing inspection to examine carefully and critically all materials, fixtures, piping and appurtenances, appliances and installations of a plumbing system for compliance with requirements of the Illinois plumbing code.
INSPECTOR:
A fully licensed plumber who is a certified cross-connection control device inspector ("CCCDI").
NON-POTABLE WATER:
Water not safe for drinking, personal, or culinary use as determined by the requirements of part 65 of title 35 of the Illinois Administrative Code, or any other applicable provisions of state, federal or local law.
PHYSICAL SURVEY:
The actual physical survey of the premises performed by any party contracted or otherwise retained or hired by the Village or the Public Works Department's designee to confirm the results of the written survey described below and to obtain information for the public records which will help maintain a system to protect the public water supply.
PLUMBING:
The actual installation, repair, maintenance, alteration or extension of a plumbing system by any person. Plumbing includes all piping, fixtures, appurtenances and appliances for a supply of water for all purposes from the source of a private water supply on the premises or from the main in the street, alley or at the curb to, within and about any building or buildings where a person or persons live, work or assemble. Plumbing includes all piping, from discharge of pumping units to and including pressure tanks in water supply systems. Plumbing includes all piping, fixtures, appurtenances, and appliances for a building drain and a sanitary drainage and related ventilation system of any building or buildings where a person or persons live, work or assemble from the point of connection of such building drain to the building sewer or private sewage disposal system five feet (5') beyond the foundation walls.
POLLUTION:
The presence of any foreign substance (organic, inorganic, radiological, or biological) in water that tends to degrade its quality so as to constitute a hazard or impair the usefulness of the water.
POTABLE WATER:
Water which meets the requirements for water being used for drinking, culinary, and domestic purposes as set forth in part 65 of title 35 of the Illinois Administrative Code, or any other applicable provisions of state, federal or local law.
POTENTIAL CROSS-CONNECTION:
A fixture or appurtenance with threaded hose connection, tapered spout, or other connection which would facilitate extension of the water supply line beyond its legal termination point.
PREMISES:
The property location in which the customer's building plumbing system or water system is located and any property which is in any manner connected to a public water system.
PROCESS FLUID(S):
Any fluid or solution which may be chemically, biologically or otherwise contaminated or polluted in a form or concentration such as would constitute a health, pollution, or system hazard if introduced into the public or a customer's potable water system. This includes, but is not limited to:
1.   Polluted or contaminated waters;
2.   Process waters;
3.   Used waters originating from the public water supply system which may have deteriorated in sanitary quality;
4.   Cooling waters;
5.   Questionable or contaminated natural waters taken from wells, lakes, streams, or irrigation systems;
6.   Chemicals in solution or suspension;
7.   Oils, gases, acids, alkalis and other liquid and gaseous fluids used in industrial or other processes, or for firefighting purposes.
PUBLIC WATER SUPPLY:
All mains, pipes and structures through which water is obtained and distributed to the public, including wells and well structures, intakes and cribs, pumping stations, treatment plants, reservoirs, storage tanks and appurtenances, collectively or severally, actually used or intended for use for the purpose of furnishing water for drinking or general domestic use and which serve at least fifteen (15) service connections or which regularly serve at least twenty five (25) persons at least sixty (60) days per year. A public water supply is either a "community water supply" or a "noncommunity water supply".
PUBLIC WORKS DEPARTMENT:
The department in charge of the Village public works which, among other things, supervises varied activities associated with obtaining, treating and distributing water to Village residents, businesses, industries and other users and directs the operation, maintenance and repair of pump stations, reservoirs, transmission lines and other equipment associated with the Village public water supply and/or distribution system.
REDUCED PRESSURE PRINCIPLE BACKFLOW PREVENTION DEVICE:
A device containing a minimum of two (2) independently acting check valves together with an automatically operated pressure differential relief valve located between the two (2) check valves and approved under ASSE standard 1013. During normal flow and at the cessation of normal flow, the pressure between these two (2) checks shall be less than the supply pressure. In case of leakage of either check valve, the differential relief valve, by discharging to the atmosphere, shall operate to maintain the pressure between the check valves at less than the supply pressure. The unit must include tightly closing shutoff valves located at each end of the device, and each device shall be fitted with properly located test cocks.
SCHEDULE OF FINES AND FEES:
The fines and fees applicable to this section as referenced in the text of this section and set forth in exhibit A attached to Ordinance 2019-27, which may be amended from time to time at the sole discretion of the Village of Broadview corporate authorities ("schedule of fines and fees").
SECONDARY CROSS-CONNECTION DEVICE:
Any other water system or cross control device and which is designed for cross-connection control by isolation and which is not a primary, domestic or primary sprinkler cross-connection control device and which is part of the customer's water system.
SERVICE CONNECTION:
The opening, including all fittings and appurtenances, at the water main through which water is supplied to the user.
SYSTEM HAZARD:
A condition through which an aesthetically objectionable or degrading material not dangerous to health may enter the public water supply system or a customer's potable water system.
USED WATER:
Any water supplied by a public water supply system to a customer's water system after it has passed through the service connection and is no longer under the control of the Village water supply.
WATER PURVEYOR:
The owner or official custodian of a public water system.
WRITTEN SURVEY:
The written document sent to each industrial, commercial and residential customer by the Public Works Department for the purpose of collecting information pertaining to the customer's piping system regarding the location of all connections to the public water supply system and the existence of plumbing fixtures. The customer is required to complete, execute and forward the response to the written survey to the Public Works Department. The written survey will request information which requests responses regarding the location, type and most recent inspection and testing date of all cross-connection control devices and methods located within that customer's piping system. The written survey must be in written form and should not be an actual plumbing inspection. The Village is conducting the written survey to obtain accurate contact information for each customer and to create up to date records regarding all cross-connections within the Village. If the written survey is not completed by the customer, such survey shall be completed by the Public Works Department's designee at the time of the physical survey.
 
   C.   Purpose: The purpose of the cross-connection control program is to:
      1.   Protect the public water supply system from contamination or pollution by isolating within the customer's water system, contaminants or pollutants which could backflow through the service connection into the water supply system.
      2.   Promote the elimination or control of existing cross-connections, actual or potential between the public or customer's potable water system and non-potable water systems, plumbing fixtures and sources of systems containing substances of unknown or questionable safety.
      3.   Provide for the maintenance of a continuing program of cross-connection control which will prevent the contamination or pollution of the public and consumer's potable water systems.
   D.   Policy: The customer of the premises shall be responsible for protection of the public water supply system from contamination due to backflow or back siphonage of contaminants through the customer's water service connection. If the Public Works Department or any party contracted or otherwise retained or hired by the Village determines that an approved backflow prevention device is necessary for the safety of the public water supply system, the Public Works Department shall give notice to the customer to install such approved backflow prevention device at each service connection to the premises. The customer shall immediately install such approved device or devices at the customer's own expense in a location and in a manner in accordance with the Village ordinance and all applicable regulations and shall have inspections and tests made of such approved device upon installation and as required by the Village ordinance. The failure, refusal or inability on the part of the customer to install such device or devices immediately shall constitute grounds for discontinuing water service to the premises until such device or devices have been installed. The customer shall retain records of installation, maintenance, testing and repair as required herein for a period of at least five (5) years. The Public Works Department may require the customer to submit a cross-connection inspection report to the Village to assist in determining whether or not service line protection will be required. All cross-connection inspections shall be conducted by the Public Works Department or performed by any party contracted or otherwise retained or hired by the Village.
   E.   Cross-Connection Prohibited: Connections between potable water systems and other systems or equipment containing water or other substances of unknown or questionable quality are prohibited except when and where approved cross-connection control devices or methods are installed, tested and maintained to ensure proper operation on a continuing basis. No physical connection shall be permitted between the potable portion of a supply and any other water supply not of equal or better bacteriological and chemical quality as determined by inspection and analysis by the agency. There shall be no arrangement or connection by which an unsafe substance may enter a public water supply or water supply for the premises.
   F.   Backflow Prevention Device Required: All plumbing installed within the Village shall be installed in accordance with the Illinois plumbing code. If in accordance with the Illinois plumbing code or by the determination of the Public Works Department or any party contracted or otherwise retained or hired by the Village, an approved backflow prevention device is necessary for the safety of the public water supply system, the Public Works Department will give notice to the water customer to have such an approved device installed immediately. The type of device protection required shall depend on the degree of hazard which exists and shall be at the discretion of the Public Works Department. The water customer shall, at the water customer's own expense, install such approved device at a location and in a manner in accordance with the Illinois plumbing code and all applicable Village municipal ordinance provisions including permits for said work, and shall have inspections and tests made of such approved devices upon installation and as required by the Illinois plumbing code and provisions as stated herein.
In the event that there is any addition or alteration to an automatic or fire sprinkler system or the installation of a backflow device onto a fire or sprinkler system, a thorough hydraulic analysis shall be performed to ensure that the installation of the backflow system does not result in pressure loss to the system that compromises the fire safety system. In the event that there is a loss of pressure, the customer shall restore the pressure in the system to operate at the required safety levels. Prior to installing a backflow device onto a fire or sprinkler system the customer shall submit all hydraulic calculations and backflow prevention device specifications to the fire department to ensure that fire requirements have been met.
   G.   Water Customer Responsibility: It shall be the responsibility of the water customer to prevent backflow into the public water system by ensuring that:
      1.   All cross-connections are removed or approved cross-connection control devices are installed for control of backflow and back siphonage.
      2.   Cross-connection control devices are installed in accordance with the manufacturer's instructions.
      3.   Cross-connection control devices are inspected at the time of installation and tested annually by any party contracted or otherwise retained or hired by the Village that is a certified Cross Connection Control Device Inspector (CCCDI) and an agent of the Village. The inspection of mechanical devices shall include physical testing in accordance with the manufacturer's instructions.
      4.   The customer has retained any and all manufacturer's instructions and schematics with regard to the cross-connection control device. The customer shall present the same to any party contracted or otherwise retained or hired by the Village and the Public Works Department designee, when requested.
      5.   Any new construction, change of ownership or rehabilitation of existing residential and nonresidential premises shall be required to be in compliance with this section and shall be subject to the permitting process of the Village.
   H.   Additional Water Supplies: No person, firm or corporation shall establish or permit to be established or maintain or permit to be maintained any connection whereby a private, auxiliary or emergency water supply other than the regular public water supply of the Village enters the supply or distribution system of the Village, unless such private, auxiliary or emergency water supply and the method of connection and use of such supply shall have been approved by the Public Works Department and the IEPA.
   I.   Written Surveys: The Public Works Department will cause written surveys to be issued and investigations to be made of both residential and nonresidential premises served by the public water supply to determine whether actual or potential hazards to the public water supply and the premises may exist and to accurately keep records of the existence of any cross-connection devices.
      1.   Timing And Administration Of Written Survey: Such written surveys and investigations shall be made as often as the Public Works Department shall deem necessary. Because of the large quantity of residential and nonresidential buildings, the Public Works Department has the discretion to stagger the distribution of the written surveys. Records of such written surveys shall be maintained and available for review. Written surveys shall be served via U.S. mail first class ("initial notice"). The customer shall return the written survey to the Public Works Department no later than ten (10) days following the date on the initial notice.
      2.   Failure To Respond To Written Survey: Should a customer fail to provide the information required by the written survey, in the time specified by the written survey, then the Public Works Department shall provide another letter requesting that the written survey be completed and returned within five (5) days from the date on the second notice ("second notice"). If the customer still fails to return the written survey to the Public Works Department on the sixteenth day after the date of the second notice, the Public Works Department shall have the right to disconnect water service until compliance with the written survey is achieved. In addition, the failure to submit a completed written survey will be considered a violation of this section and will subject the customer to the fines set forth in the schedule of fines and fees, and any of the remedies set forth in subsection L of this section.
   J.   Physical Survey: The Public Works Department will cause physical surveys to be made of both residential and nonresidential premises served by the public water supply to determine whether actual or potential hazards to the public water supply may exist and the existence of any cross-connections and any cross-connection devices.
      1.   Timing And Administration Of Physical Survey: Such physical surveys shall be made as often as the Public Works Department shall deem necessary. Such physical surveys will be performed by a CCCDI registered with and selected by the Village. The cost of the physical survey shall be based on the schedule of fines and fees and shall be payable to the Village. Records of such physical surveys shall be maintained and available for review. The Village may also send any party contracted or otherwise retained or hired by the Village for the purpose of verifying the presence or absence of cross-connections and cross-connection devices with the public water supply or within the premises. On demand, the customer of the premises so served shall furnish to the Public Works Department any information, which the Public Works Department may request regarding the plumbing and piping system or systems or water use on such premises.
      2.   Failure To Respond To Physical Survey Or Failure To Provide Information: The refusal of such information, when demanded, shall, within the discretion of the Public Works Department, be deemed evidence of the presence of improper connections as provided in this section and may subject the customer to a disconnection from the public water supply after reasonable notice and a fine as set forth in the schedule of fines and fees.
   K.   Inspection, Testing, Records And Repairs: Each cross-connection device and secondary cross-connection device shall be tested by any party contracted or otherwise retained or hired by the Village after the physical survey, at the time of installation of the cross-connection device and at least annually or more frequently if recommended by the manufacturer depending on the type of hazard.
      1.   Inspection And Testing Of Cross-Connection Devices: If it is determined by the Public Works Department and/or any party contracted or otherwise retained or hired by the Village that there exists a cross-connection or cross-connection device(s) as specified by this section, agency regulations or other law, the following shall apply:
         a.   Village Notice To The Customer: The Village shall issue notice to the customer that the customer's connection(s) to the Village's public water supply or distribution and the customer's plumbing system and all cross-connection devices and secondary cross-connection devices must be inspected and tested by any party contracted or otherwise retained or hired by the Village who is registered with and selected by the Village. The notice shall also contain the cost of the inspection and testing as set forth in the schedule of fines and fees.
         b.   Scheduling Of The Inspection And Testing: After receiving the notice from the Village, the customer shall call the Village Public Works Department, or any party contracted or otherwise retained or hired by the Village, to schedule the inspection and testing. The inspection and testing must be completed within the time period as specified in the notice. The CCCDI who will conduct the inspection may be any party contracted or otherwise retained or hired by the Village.
         c.   Reporting To The Village: Upon completion of the inspection and testing, the party contracted or otherwise retained by the Village shall prepare and deliver to the customer a certified record of the test results. Within five (5) business days after the inspection and testing of the cross-connection device by the Village's contractor, the Village's contractor shall submit the certified record of the test results to the Village for each of the devices tested. A copy of the Village's contractor's documents evidencing certification as a CCCDI with a current agency approval number, a copy of the contractor's current Illinois plumbing license, and proof of insurance with the Village listed as an additional insured, must be on file with the Village prior to performing any inspections and testing. Records submitted shall be available for inspection by agency personnel in accordance with 415 Illinois Compiled Statutes 5/19.
         d.   Tagging Of Device: Following each inspection and testing each cross-connection device shall have a tag attached listing the date of the most recent test, name and approval number of the party contracted or otherwise retained by the Village performing the test, test results certified by the party contracted or otherwise retained by the Village, repairs or servicing required, repairs or services performed and date repairs and services completed. A maintenance log shall be maintained at the premises for each device which includes all testing and repairs done since installation.
         e.   Compliance Prior To The Effective Date Hereof: Notwithstanding the foregoing, if at the time of the physical survey or anytime prior to the first inspection and testing following the initial physical survey following the passage of this section, the customer provides the Village with certified test results for the cross-connection devices and other documents required in full compliance with this section, the customer may submit the required documents as specified in this subsection along with the applicable fees, if any, as specified in the schedule of fines and fees. In order for the Public Works Department to maintain a system of uniformity, the Public Works Department may set a new annual inspection date that may be less than three hundred sixty five (365) days from the previous inspection and testing.
      2.   Determination Of Lack Of Compliance After Inspection And Testing: If the party contracted or otherwise retained by the Village determines that the cross-connection device is not in compliance with applicable laws or that a cross connection exists without a cross-connection device in place, said party contracted or otherwise retained by the Village shall immediately notify the Village Public Works Department and the customer shall take steps to remedy the situation no later than five (5) business days thereafter. The customer shall hire a CCCDI registered in the Village and fully licensed to conduct the repair. Upon repairing the device or otherwise bringing the cross-connection device or cross-connection into compliance with this section, the cross-connection device or cross-connection shall be reinspected by the a party contracted or otherwise retained by the Village for reinspection. The customer shall be responsible for all applicable fees and costs for any reinspection by any party contracted or otherwise retained by the Village and may be provided prior to inspection upon customer's request. In the event that the customer informs the Public Works Department of extenuating circumstances as to why the correction cannot or has not been made within five (5) business days of being notified of the lack of compliance, a time extension may be granted at the discretion of the Public Works Department.
   L.   Failure To Comply: If it is determined that a premises is not in compliance with this section, agency regulations or other law, the premises, cross-connection or cross-connection devices must be brought into compliance immediately. The Public Works Department is hereby authorized and directed to act as follows in the enforcement of this section.
      1.   Discontinuance Of Water Service With Notice: The Public Works Department of the Village is hereby authorized and directed to discontinue, after reasonable notice to the occupant thereof, the water service to any premises wherein any connection in violation of the provisions of this section is known to exist, and to take such other precautionary measures as the Public Works Department may deem necessary to eliminate any danger of contamination of the public water supply distribution mains. Water service to such premises shall not be restored until such conditions have been eliminated or corrected in compliance with the provisions of this section, and until a reconnection fee as listed in the schedule of fines and fees is paid to the Village.
      2.   Discontinuance Of Water Service Without Notice: Immediate disconnection can be effected when the Public Works Department believes that imminent danger of harmful contamination of the public water supply system exists with as much notice as possible. Such action shall be followed by verbal and written notification of the cause of disconnection. Immediate disconnection without notice to any party can be effected to prevent actual or anticipated contamination or pollution of the public water supply, provided that, in the reasonable opinion of the Public Works Department or the Illinois Environmental Protection Agency, such action is required to prevent actual or potential contamination or pollution of the public water supply.
      3.   Issuance Of A Violation Notice: Issue a violation notice to the customer, pursuant to this section, for not being in compliance with this section and which shall be adjudicated by the code hearing department procedures in title 1, chapter 13 of this code. Parties found to have violated the provisions of this Chapter may be assessed a fine not to exceed $750 for each violation, where each day that the violation occurs or continues shall be deemed a separate and distinct violation.
      4.   Disconnection Of Water Service For Failure To Pay Fines And Fees: At the discretion of the Public Works Department, water service to the premises will continue to be disconnected if the customer does not come into compliance and pay any outstanding fines and fees, including but not limited to any reconnection fees as established by the Village, after being provided with reasonable notice of the same.
      5.   An attempt to shut off the domestic water supply and leave the fire suppression water line intact is recommended, whenever possible. If for any reason the suppression system is shut off to ensure compliance, the Village of Broadview Fire Department Chief and Fire Inspector must be notified at the time of shut off. The Village of Broadview Fire Department will notify business representatives and direct them as to the procedures associated with water shut off and how it pertains to the safely of their employees and building structure.
   M.   Permits: The installation of any cross-connection device or secondary cross-connection device and the elimination of any cross-connection in violation of this section requires the completion of a building permit and full compliance with all provisions of this code.
   N.   Customer Responsibility: The customer responsible for back siphoned material or contamination through backflow, if contamination of the potable water supply system occurs through an illegal cross-connection or an improperly installed, maintained or repaired device, or a device which has been bypassed, must bear the cost of cleanup of the potable water supply system.
   O.   Nonliability: Neither the Village nor its employees, directors, trustees, agents or assigns shall be liable to any customer for any injury, damages nor lost revenues which may result from termination of said customer's water supply in accordance with the terms of this section, whether or not said termination was with or without notice.
   P.   Administrative Adjudication: Any violation notice issued pursuant to the provisions of this section shall be governed by the code hearing department procedures in title 1, chapter 13 of this code.
   Q.   Property Transfer: All residential, commercial, and industrial properties being transferred within the Village shall fully comply with this section and shall be required to complete a written survey, have a physical survey, have an inspection and testing of any and all devices, pay all necessary fees and fines and take all necessary action to be in compliance with this section and this code prior to closing on the sale.
