5-2-6: ENFORCEMENT; FIRE PREVENTION INSPECTIONS AND FEES:
   A.   Enforcement: The Fire Code shall be enforced by the Bureau of Fire Prevention in the Fire Department.
   B.   Fire And Life Safety Code Violations: The Fire Chief, Fire Code Official or any other person designated by the Broadview Fire Prevention Bureau to enforce its rules and regulations, may make such inspections on property or premises within the Village as are deemed necessary to enforce the provisions of the fire prevention code and any other applicable codes adopted by the Village. Such inspections may be initiated by certain fire and life safety violations including, but not limited to, the following:
      1.   Blocked Exits: Any obstruction in the required width of a means of egress. ("Means of Egress" is the continuous and unobstructed path of vertical and horizontal egress travel from any point in a building or structure to a public way, consisting of three (3) separate and distinct parts: the exit access, the exit, and the exit discharge.)
      2.   Unauthorized Storage: The storage of flammable, combustible (including pallets) or hazardous liquids or materials improperly stored or kept and/or stored or kept without a permit. (This violation applies to facilities that are required to report under the Hazardous Chemicals Right-to-Know Act.)
      3.   Spraying Operation Not In Compliance: Spraying flammable or combustible finishes without a properly installed spray booth or approved spraying area.
      4.   Alarm/Suppression System Not Tested: Failure to have required maintenance test conducted on fire alarm system(s) or sprinkler systems or fire suppression systems, and to have required documentation of test(s).
      5.   Use of Unauthorized Heating Device: The use of non-listed heating appliances and/or heating appliances used in an unapproved manner or location. There should be no storage or combustibles within three feet (3') of electrical panels or heating appliances and there is to be no stock or storage within eighteen inches (18") of any sprinkler heads.
      6.   Street Address Numbers Not Visible: Failure to post street address numbers where visible from the street or primary emergency means of egress. Address numbers shall be Arabic numerals or alphabet letters. Numbers shall be a minimum of 4-inches (102mm) high with a minimum stroke width of 0.5-inch (12.7mm).
      7.   Extinguisher Refill: Failure to properly maintain and service required portable fire extinguishers.
      8.   Emergency/Exit Lighting Not Tested: Failure to provide documentation on the following:
         a.   Emergency Generator: Monthly thirty (30) minute load test required;
         b.   Battery Packs: Thirty (30) seconds: monthly thirty (30) minutes annually.
      9.   Approved Fire Evacuation Plan: Required to be completed, filed with the Broadview Fire Prevention Bureau and posted onsite in plain view near all exits and other places required by law, ordinance, or codes adopted by the Village.
      10.   Commercial Cooking Processes: A Class K fire extinguisher shall be mounted within thirty feet (30') of commercial food equipment using vegetable or animal oils.
         a.   Commercial cooking systems shall be serviced semi-annually or as required by code.
         b.   Hoods, grease removal devices, fans, ducts and other appurtenances shall be cleaned to bare metal. Cleaning shall be recorded, and records shall state the extent, time and date of cleaning.
         c.   Records shall be maintained on premises
         d.   Fire-resistance-rated construction shall be maintained (no holes in walls or ceilings).
   C.   No Reinspection Required: If upon such initial inspection, violations of the fire prevention code are discovered, the inspector shall give the owner, tenant or occupant an inspection report listing said violations and setting the date by which said violations shall be remedied or abated. If the violations are classified as minor in nature, the inspector, in his or her sole discretion, may issue a corrective action report. In such case, the owner or occupant need only make the necessary repairs or corrections as listed and certify same in writing to the inspector in the time and manner set forth in the report. No charge will be assessed for compliance in this manner since a reinspection is not required
   D.   Self-Inspections: "Self-Inspections" will be offered to certain businesses within the Village that meet certain criteria outlined by the Broadview Fire Prevention Bureau or the Village or are otherwise qualified as determined by the Broadview Fire Prevention Bureau or the Village. No charge is imposed for such inspections. In most cases, the inspector or qualified personnel will contact the owner or responsible party of record when these inspections are due. Any failure by the inspector or qualified personnel to contact the owner or responsible party does not negate the inspection requirements contained herein.
   E.   Reinspection Required: If upon initial inspection, violation(s) of the fire prevention code is (are) such that the inspector determines a reinspection is necessary or if the owner or occupant has not returned the certified corrective action report set forth above in division C within the designated time period, then the inspector shall cause a reinspection of the property to determine whether there is compliance with the code. If it is determined that a violation or violations continue to exist, the owner, tenant or occupant, as the case may be, shall be assessed a fifty dollar ($50.00) reinspection fee for the initial reinspection unless there are circumstances which exist, to the satisfaction of the inspector, justifying the delay in the compliance. Should further reinspection be required, additional reinspection fees shall be charged as follows:
      1.   Second Inspection: Seventy five dollars ($75.00);
      2.   Third Inspection: One hundred fifty dollars ($150.00);
      3.   Fourth Inspection (and any inspections beyond the fourth): Two hundred fifty dollars ($250.00).
   F.   Adjustment Of Fees: The fees noted in Section division C above may be adjusted due to size of occupancy, building business or the complexity or nature of the inspection required. (Ord. 92-4, 2-17-1992; amd. Ord. 2018-33, 12-17-2018; Ord. 2020-2, 1-21-2020)
