4-15-4: SPECIFIC LIMITATIONS:
For the purposes of this chapter, acts declared to be excessive, loud, raucous or unnecessary noises include, but are not limited to, the following:
   A.   Instruments And Sound Amplification Devices: The playing, using, operating or permitting to be played, used or operated of any musical instrument or sound amplification device, or combination thereof, played or operated in such a manner as to disturb the peace, quiet comfort and repose of the neighboring inhabitants or at more volume than is necessary for the convenient hearing for the person or persons who are in the room, chamber, vehicle or outdoor area, within the Village limits, in which or where such instrument or sound amplification device is played, used or operated and who are voluntary listeners thereto. The playing, use or operation of any such instrument or sound amplification device between the hours of ten o'clock (10:00) P.M. and eight o'clock (8:00) A.M. in such manner as to be plainly audible for a continuous period of one minute or more at a distance of seventy five feet (75') from the location of such instrument or sound amplification device shall be prima facie evidence of a violation of this section.
   B.   Yelling, Shouting, And Similar Activities: Yelling, shouting, hooting, whistling or singing in the public parks, parkways and streets of the Village, particularly between the hours of ten o'clock (10:00) P.M. and eight o'clock (8:00) A.M., or at any other time or place so as to annoy or disturb the peace, quiet, comfort or repose of persons in any office, business establishment, dwelling or residence or of any person in the vicinity within the limits of the Village.
   C.   Advertising Noise Or Attention: The playing, using, operating or permitting to be played, used or operated of any instrument or sound amplification device which is cast upon the public streets, parks and parkways of the Village for the purpose of commercial advertising or of attracting the attention of the public to any building or structure, except when a permit has first been procured from the proper Village authorities.
   D.   Animals: The keeping of any animal within any yard, house, enclosure, garage or other place within the Village, which by frequent or long continued barking, howling, crying, singing or other noise shall disturb the peace, quiet, comfort or repose of persons in any neighboring dwelling or residence or of persons in the vicinity within the limits of the Village.
   E.   Construction; Landscaping: The conduct of any outside construction, excavation, demolition, alteration or repair work, or landscaping activities other than between the hours of seven o'clock (7:00) A.M. and six o'clock (6:00) P.M. on week days, and between nine o'clock (9:00) A.M. and six o'clock (6:00) P.M. on weekends, except in case of urgent necessity in the interest of public health and safety, and then only with the written permission of the Building Director, which permit may be granted for a period not to exceed three (3) days or less while the emergency continues. The permit may be renewed for periods of three (3) days or less while the emergency continues. The Building Director should, in making a determination regarding such a permit request that the permittee will suffer loss or inconvenience in the absence of such a permit, that the public health and safety necessitate such work, and that the noise generated during the hours requested will not negatively impact or impair persons or businesses in the vicinity.
   F.   Exhausts: The discharge into the open air of the exhaust of any steam engine, stationary internal combustion engine, motorboat or motor vehicle except through a muffler or other device which will effectively prevent loud or explosive noises therefrom.
   G.   Blowers And Generators: The use or operation of any noise creating blower, power fan, or internal combustion generator within twenty five feet (25') of any residential property between the hours of eight o'clock (8:00) P.M. and seven o'clock (7:00) A.M.
   H.   Defect In Vehicle Or Load: The use of any automobile, truck, cart, trailer, motorcycle or other vehicle, so out of repair or loaded in such a manner or with material of such nature so as to create loud, excessive or unnecessary grating, grinding, rattling or other noises.
   I.   Loading/Unloading: Causing, allowing or permitting the loading, unloading, opening or handling of boxes, crates. containers, garbage cans or recyclable containers between the hours of eight o'clock (8:00) P.M. and seven o'clock (7:00) A.M. daily when such operations are conducted on a property within the Village located within seventy five feet (75') of any residential property within the Village, measured from the property line of the residential property.
   J.   Drums: The use of any drum or similar instrument or device for the purpose of attracting attention, by the creation of noise, to any place of business, entertainment or public assembly.
   K.   Horns And Signaling Devices: The use or operation of any horn or signaling device on any motor vehicle within the Village, except as a danger warning or in an emergency. No person shall use or operate any horn or signaling device operated by an engine exhaust or for the purpose of attempting to increase traffic flow or move traffic in any manner.
