§ 153.036 GENERAL STANDARDS FOR FLOOD HAZARD REDUCTION.
   The following use and development standards apply to development wholly within, partially within or in contact with any special flood hazard area as established in §§ 153.030(F) or153.034(D)(1):
   (A)   Prohibited uses. Within a flood plain district no property shall be used, arranged to be used, or designated to be used for one or more of the following uses:
      (1)   Residential. Residential uses are prohibited;
      (2)   Commercial. Commercial uses, except for those provided in division(C)(2) below are prohibited;
      (3)   Industrial. Industrial uses, except for those provided in division (C) below are prohibited;
      (4)   Private water supply systems. Private water supply systems in all special flood hazard areas identified by FEMA, permitted under R.C. § 3701; and
      (5)   Infectious waste treatment facilities. Infectious waste treatment facilities in all special flood hazard areas, permitted under R.C. § 3734.
   (B)   Permitted uses. The Village Flood Plain Administrator may issue development permits for uses listed herein subject to the specific review elements listed in § 153.033(A):
      (1)   Agricultural production;
      (2)   Publicly or privately owned parks, playgrounds and similar recreational uses;
      (3)   Wildlife refuge, game or hunting preserve;
      (4)   Transient amusement activities such as circuses, sideshows, carnivals and festivals, provided all other appropriate permits have been issued and subject to § 153.380(A), (B), (C), (E) and (G);
      (5)   Public facilities as deemed necessary by the Village Planning Commission and the Village Council;
      (6)   Private or governmentally owned and/or operated picnic areas, playgrounds, private parks, swimming facilities, golf courses, tennis clubs, country clubs, riding academies, and other similar recreational facilities and/or uses, but excluding such commercial recreational uses as drive-in theaters, miniature golf courses, golf driving ranges, rifle ranges, skeet shooting ranges, pistol ranges, or other ranges for the use of firearms. Uses permitted under this category shall be subject to § 153.380(A), (B), (C), (D) and (E); and
      (7)   Off-street parking as permitted and regulated in §§ 153.330 through 153.335, subject to §§ 153.380(E), 153.381, 153.382, 153.395 and 153.396.
   (C)   General standards.
      (1)   Habitable buildings or structures are prohibited.
      (2)   New construction and substantial improvement of any commercial, industrial or other nonresidential structure shall be anchored to prevent flotation, collapse or lateral movement of a structure resulting from hydrodynamic and hydrostatic loads, including buoyancy. Where a structure, including its foundation members, is elevated on fill or above the base flood elevation, the requirements for anchoring in this division (C)(2) and construction materials resistant to flood damage in division (C)(3) below are satisfied.
      (3)   New construction will be of methods and materials resistant to flood damage.
      (4)   New construction shall be with electrical, heating, ventilation, plumbing and air conditioning equipment and service facilities that are designed and/or elevated so as to prevent water from entering or accumulating within the components during conditions of flooding.
      (5)   The following standards apply to all new or substantially improved nonresident and non-habitable non-basement structures which are elevated to the base flood elevation using pilings, columns, posts or solid foundation perimeter walls with opening sufficient to allow unimpeded movement of flood waters. Fully enclosed areas below the lowest floor that are used solely for the parking of vehicles, building access or storage in an area other than a basement, and which are subject to flooding shall be designed to automatically equalize hydrostatic flood forces on exterior walls by allowing for entry and exit of flood waters. Designs meeting this requirement must:
         (a)   Be used for the parking of vehicles, building access or storage; and
         (b)   Be certified by a registered professional engineer or architect to automatically equalize hydrostatic flood forces on exterior walls by allowing for entry or exit of flood waters; or
         (c)   Must have a minimum of two openings have a total area of not less than one square inch for every square foot of enclosed area subject to flooding shall be provided, and the bottom of the openings shall be no higher than one foot above grade. Openings may be equipped with screens, louvers, valves or other coverings or devices provided that they permit automatic entry and exit of flood waters.
      (6)   New construction and substantial improvement of any commercial, industrial or other nonresidential structure shall either have the lowest floor, including basement, elevated to or above the level of the flood protection elevation; or, together with attendant utility and sanitary facilities, shall meet all of the following standards:
         (a)   Be dry flood-proofed so that the structure is water-tight with walls substantially impermeable to the passage of water to the level of the flood protection elevation;
         (b)   Have structural components capable of resisting hydrostatic and hydrodynamic loads and effects of buoyancy; and
         (c)   Be certified by a registered professional engineer or architect through the use of a Federal Emergency Management flood-proofing certificate, that the design and methods of construction are in accordance with this division (C).
   (D)   Uses; accessory buildings. A relief to the elevation or dry flood-proofing standards may be granted for accessory structures, such as storage sheds, that contain no more than 576 square feet. Such structures must meet the following standards:
      (1)   They shall not be used for human habitation;
      (2)   They shall be of flood resistant materials;
      (3)   They shall be constructed and placed on the building site as to offer minimum resistance to the flow of flood waters;
      (4)   They shall be firmly anchored to prevent flotation;
      (5)   Service facilities such as electrical and heating equipment shall be elevated or flood-proofed or to be above the base flood elevation; and
      (6)   They shall meet the opening requirements of division (C) above.
   (E)   Water and wastewater systems. The following standards apply to all water supply, sanitary sewerage and waste disposal systems not otherwise regulated by the Ohio Revised Code:
      (1)   All new and replacement water supply systems shall be designed to minimize or eliminate infiltration of flood waters into the systems;
      (2)   New and replacement sanitary sewerage systems shall be designed to minimize or eliminate infiltration of flood waters into the systems and discharge from the systems into flood waters; and
      (3)   On-site waste disposal systems shall be located to avoid impairment to or contamination from them during flooding.
   (F)   Subdivisions and large developments.
      (1)   Residential subdivisions are prohibited under division (A) above, but nonstructural and agricultural subdivisions are permitted in accordance with the following:
         (a)   All subdivision proposals shall be consistent with the need to minimize flood damage and are subject to all applicable standards in these regulations;
         (b)   All subdivision proposals shall have public utilities and facilities such as sewer, gas, electrical and water systems located and constructed to minimize flood damage;
         (c)   All subdivision proposals shall have adequate drainage provided to reduce exposure to flood damage; and
         (d)   In all areas of special flood hazard where base flood elevation data are not available, the applicant shall provide a hydrologic and hydraulic engineering analysis that generates base flood elevations for all subdivision proposals and other proposed developments containing at least 50 lots or five acres, whichever is less.
      (2)   The applicant shall meet the requirement to submit technical data to FEMA in § 153.034(A)(1) when a hydrologic and hydraulic analysis is completed that generates base flood elevations as required by § 153.034.
   (G)   Recreational vehicles. Recreational vehicles must meet at least one of the following standards:
      (1)   They shall not be located on sites in special flood hazard areas for more than 180 days;
      (2)   They must be fully licensed and ready for highway use; or
      (3)   They must meet all standards of division (C) above.
   (H)   Above ground gas or liquid storage tanks. All above ground gas or liquid storage tanks shall be anchored to prevent flotation or lateral movement resulting from hydrodynamic and hydrostatic loads.
