§ 53.151 ADMINISTRATIVE FINES; DISPUTING FINES.
   (A)   When the Superintendent finds that a user has violated, or continues to violate, any provision of this chapter, an individual wastewater discharge permit, order issued hereunder or any other pretreatment standard or requirement, the Superintendent may fine such user. Such fines shall be assessed on a per-violation, per-day basis. In the case of monthly or other long-term average discharge limits, fines shall be assessed for each day during the period of violation.
   (B)   Unpaid charges, fines and penalties shall, after 180 calendar days, be assessed an additional penalty of 10% of the unpaid balance, and interest shall accrue thereafter at a rate of 1% per month. A lien against the user’s property shall be sought for unpaid charges, fines and penalties.
   (C)   Users desiring to dispute such fines must file a written request for the Superintendent to reconsider the fine, along with full payment of the fine amount, within 180 days of being notified of the fine. Where a request has merit, the Superintendent may convene a hearing on the matter. In the event the user’s appeal is successful, the payment, together with any interest accruing thereto, shall be returned to the user. The Superintendent may add the costs of preparing administrative enforcement actions, such as notices and orders, to the fine.
   (D)   Issuance of an administrative fine shall not be a bar against, or a prerequisite for, taking any other action against the user.

BILLING AND PAYMENT
§ 53.165 MONTHLY BILLING.
   (A)   Rates and charges shall be prepared, billed and collected by the town in the manner provided by law and ordinance.
   (B)   The rates and charges for all users shall be prepared and billed monthly.
   (C)   The rates and charges may be billed to the tenant or tenants occupying the properties served unless otherwise requested in writing by the owner, but such billings shall in no way relieve the owner from liability in the event payment is not made as herein required. The owners of properties served which are occupied by a tenant or tenants shall have the right to examine the collection records of the town for the purpose of determining whether bills have been paid by such tenant or tenants, provided that such examination shall be made at the office at which said records are kept and during the hours that such office is open for business.
   (D)   As is provided by statute, all rates and charges not paid when due are hereby declared to be delinquent and a penalty of 10% of the amount of the rates or charges shall thereupon attach thereto. The time at which such rates or charges shall be paid is fixed at 15 days after the date of mailing of the bill.
   (E)   In the event of a clerical billing error in favor of the customer, the town may correct said error and bill the correct amount to the customer within five years of the month in which the bill was originally due.

§ 53.999 PENALTY.
   (A)   Any person violating any provision of this chapter for which no specific penalty is prescribed shall be subject to § 10.99 of this code of ordinances.

Such fine shall be assessed on a per-violation, per-day basis. In the case of monthly or other long-term average discharge limits, fines shall be assessed for each day during the period of violation.
      (2)   Unpaid charges, fines and penalties shall, after 180 calendar days, be assessed an additional penalty of 10% of the unpaid balance, and interest shall accrue thereafter at a rate of 1% per month. A lien against the user’s property shall be sought for unpaid charges, fines and penalties.

   (D)   Disconnection/reconnection fee. The fee for disconnection/reconnection for all utility services shall be $75 during normal business hours, and the utility shall only perform reconnections during normal business hours.
   (E)   After hours service charge (non-emergency only).
      (1)   (a)   After hours and Saturdays: $70 minimum for first two hours; and
         (b)   After two hours: An additional $35 per hour per employee.
