1-5   GENERAL PENALTY PROVISION.
   It shall be unlawful for any person to violate or fail to comply with any provision of this Code of Ordinances and when no penalty is specifically prescribed therefore, the violation shall be a misdemeanor and the penalty for violation thereof shall be a fine of not less than five ($5.00) dollars and no more than five hundred ($500.00) dollars or imprisonment of not more than twelve (12) months or both. Each day any violation of any provision of this Code shall continue, shall constitute a separate offense.
   Notwithstanding the foregoing or any other provision of this Code of Ordinances, the penalty for a violation of any provision of this Code or any ordinance shall not be less than that imposed by statute or act of the Kentucky General Assembly for the same offense; therefore, all provisions of this Code which purport to fix a penalty at less than that imposed by a statute for the same offense are repealed and the penalty prescribed by said statute shall be the penalty for violation of any such ordinance.
