9-1-3-3: DEMOLITION OF STRUCTURES/NEW CONNECTION FEES:
   A.   Disconnections And Reconnections To The Village's Waterworks And Sewerage System Due To Demolition Of Structures: When any type of structure or use, listed in section 9-1-3-1 of this chapter, that is connected to the Village's waterworks and sewerage system is to be completely demolished, and all utilities, including, but not limited to, water, sanitary sewer, electric, and natural gas must be physically exposed by way of excavation, a water and sewer connection fee will be applied, as calculated by the Village Engineer or designee according to standard engineering practices relative to the determination of population equivalents (PE) using comparable water consumption data, number of employees, land area, and/or the water and sewer demand characteristics of such uses being thereby served, due to, and in consideration of one or more of the following factors: (Ord. 2015-39, 8-10-2015; amd.       1.   Increases in nonresidential water connection sizes made necessary by the Village's fire suppression requirements as provided in section 10-10-1 et seq., of this Code;
      2.   Increases in the residential water connection sizes made necessary by the general increase in the number of fixtures and fixture units in new homes; (Ord. 2015-39, 8-10-2015)
      3.   Any overall increase to the demand on the Village's water and/or sewerage system by all new or modified uses as calculated by the Village Engineer according to standard engineering practices relative to the determination of population equivalents (PE) using comparable water consumption data, number of employees, land area, and/or the water and sewer demand characteristics of such uses being thereby served; and (Ord. 2015-39, 8-10-2015; amd.       4.   Various Village water and sewerage capital improvement plans.
The water and sewer connection fee amounts will be assessed according to the provisions of section 9-1-3-2 of this chapter. A minimum fee of four (4) PE will be assessed to all business, commercial, governmental, institutional, religious, not for profit, or industrial uses. This requirement for water and sewer connection fees shall not apply to a structure which is to be rebuilt in substantially the same manner after having been destroyed by fire, wind or some other "act of God".    B.   Other Voluntary Disconnections And Reconnections: A water and sewer connection fee shall not be applied to any type of structure or use, listed in section 9-1-3-1 of this chapter, for reasons other than what is described in subsection 9-1-3-2D of this chapter, that would require the disconnection or relocation of the water and/or sanitary sewer service, such as accommodating a driveway or surface parking rehabilitation or relocation.
   C.   Disconnection From Other Municipal Systems: Whenever any property owner applies for connection to the Village's water and sewerage system and, at the time of such application has an existing water and sewer service connection to another Municipal water and sewerage system, then the water and sewer connection fee required by this section may be waived by the Village Board if the property owner disconnects from the other Municipal water and sewer system, prior to or at the time of connection to the Village's water and sewer system. All other applicable fees, charges, or expenses otherwise contained in this Code shall be paid, and the property owner shall comply with the applicable laws, codes, rules, regulations, and ordinances.
