7-3-506: PROCEDURE FOR OBTAINING APPROVAL FROM PERSONS OR ENTITIES TO INSTALL SPEED HUMPS:
   A.   Upon obtaining written approval from abutting property owners for installation of one or more speed humps at certain locations, as set forth in section 7-3-505 of this article, the department of transportation shall mail to the persons or entities listed below an informational brochure describing the proposed installation of speed humps and a survey requesting such persons or entities to identify whether they approve of or oppose the installation at the specified location. The following persons or entities shall receive an informational brochure:
      1.   The property owner or tenant residing in a single-family residence located on the block proposed for installation of speed humps.
      2.   The property owner or manager of an apartment development located on the block proposed for installation of speed humps.
      3.   The president of the homeowners' association for any condominium development located on the block proposed for installation of speed humps.
   B.   The persons or entities entitled to receive surveys shall return the surveys to the department of transportation within sixty (60) days of the date the notices are mailed by the city.
   C.   At least sixty percent (60%) of the persons or entities entitled to receive surveys must approve installation of one or more speed humps at the specified location before the humps may be installed. If less than sixty percent (60%) of such persons approve the installation, the application process shall terminate.
   D.   In determining the percentage of persons or entities who approve of or oppose installation of one or more speed humps, the department of transportation shall consider the returned surveys in the following manner:
      1.   A property owner or tenant residing in a single-family residence shall be entitled to one consent or one objection for that residence.
      2.   Each apartment development and each condominium development shall be entitled to one consent or one objection for the entire development. (Ord. 93-O-2163, eff. 2-26-1993)
