A. Upon a written determination by the director of transportation that the street block specified in the application satisfies the requirements of subsection 7-3-504A of this chapter, the eligible applicant shall obtain written approval from the property owners whose property will abut the proposed speed hump as shown in figure 1 of this section. A property owner is entitled to provide one consent or one objection to the proposed speed hump with respect to that property.
1. If the property abutting the proposed speed hump is a condominium, the eligible applicant shall obtain written approval from the property owner(s) whose window(s) face the street in which the proposed speed hump will be located. A property owner whose window(s) face the street in which the proposed speed hump will be located is entitled to provide one consent or one objection to the proposed speed hump with respect to that condominium.
2. If the property abutting the proposed speed hump is an apartment development, the eligible applicant shall obtain written approval from the owner thereof. The owner of an apartment development is entitled to provide one consent or one objection to the proposed speed hump with respect to the entire apartment development.
3. In cases where the dwelling unit is not occupied, the property owner or an authorized representative may consent or object to the proposed speed hump.
B. The eligible applicant shall contact the property owners, described in subsection A of this section, in the priority order determined by the director of transportation as the best suited locations for installation of speed humps on the street, pursuant to subsection 7-3-504B of this chapter.
C. Should any property owner on such list object to the installation, the eligible applicant shall obtain written approval from the property owners identified by the director of transportation as the next best location for installation of speed humps pursuant to subsection 7-3-504B of this chapter.
