§ 74.002 APPLICATION
   The provisions of the Kentucky Standards of Safety shall apply equally to both public and private property. They shall apply to all new structures and their occupancies including buildings, structures, equipment, etc., and except as otherwise specified, to existing structures and their occupancies including buildings, structures, equipment, etc., which constitute a clear and present hazard to life or to property.

§ 74.003 ENFORCEMENT
   (A)   The enforcement of the provisions of this chapter shall be the responsibility of the city fire chief.
   (B)   Any person aggrieved by a decision or determination of the fire chief in enforcing the provisions of this chapter may file an appeal with the code enforcement board pursuant to § 22.608.

§ 74.004 RIGHT-OF-ENTRY
   For the purpose of making surveys, inspections, and investigations, the fire chief or the building inspector is hereby authorized, upon identification and statement of purpose, to enter, inspect, survey and investigate between the hours of 8:00 a.m. and 5:00 p.m., or at any other time if an emergency exists or if requested by the owner or occupant, all buildings, dwellings, dwelling units, rooming units and general premises. The owner or occupant of every building, dwelling, dwelling unit, rooming unit and general premises, or the person in charge thereof, shall give the building inspector or fire chief free access to the building, dwelling, dwelling unit, rooming unit or general premises for the purpose of the inspection, survey or investigation.

§ 70.099 PENALTY
   Any person who shall violate any provision of this chapter or who shall fail to comply with any lawful order, rule or regulation made hereunder shall be deemed guilty of a misdemeanor and shall be fined not less than ten ($10.00) dollars nor more than five hundred ($500.00) dollars, or imprisoned for not more than sixty (60) days, or both; and each day that any such violation or failure to comply occurs, or is continued, shall constitute a separate offense.
