ARTICLE II. ENERGY EMERGENCY
The mayor of the city is hereby given the authority to declare an energy emergency, subject to the following:
(A) The declaration must be based upon and contain information concerning shortages received from energy suppliers, including but not limited to, heating fuel suppliers, electricity suppliers, transportation fuel suppliers; and
(B) The declaration must be ratified by the city council within seventy-two (72) hours after its issuance.

The energy emergency declaration may impose restrictions on all industrial, commercial and institutional operations and on the use of energy in public and private industrial, commercial and institutional operations and private residences. The restrictions may include, but are not limited, to the following:
(A) A limitation on the hours of operation of any or all commercial, industrial or institutional establishments;
(B) A limitation upon the use of lighting by any or all commercial, industrial or institutional establishments;
(C) The establishment of the thermostat setting on the premises of any or all commercial, industrial or institutional establishments;
(D) The establishment of the thermostat setting in private residences; and,
(E) The establishment of priorities for the use and allocation of any energy or power source.

(A) The energy emergency declaration imposing restrictions upon businesses or personal residences shall request voluntary compliance with its terms.
(B) In the absence of voluntary compliance with the terms of the energy emergency declaration, the mayor may issue an order directing compliance within twelve (12) hours. This order shall be served upon the noncomplying party or parties by the city police, and he shall be notified to show cause within six (6) hours after receipt of the order why his energy supply should not be discontinued for his failure to comply with the emergency order. In the event of noncompliance with the mayor's order or failure to appear and show cause, the mayor shall direct the energy supplier to discontinue service to the premises operated by the noncomplying party or parties.
