§ 23.001 DEFINITION
   For the purposes of this chapter, the following definition shall apply:
   "EMPLOYEES." All persons, other than officers as defined in § 21.001, who perform regular services for the city for monetary compensation; excluding, however, person performing such services pursuant to separate contract.

§ 23.002 APPOINTMENT OF EMPLOYEES
   The procedure for appointment of employees shall be as follows: The appropriate committee of the city council shall conduct the interviews with applicants along with the mayor or his designee, and shall recommend three (3) applicants to the mayor. The mayor shall then appoint one of the three (3) so recommended, or may reject all recommendations. In such event, the appropriate committee may make three (3) additional recommendations within ten (10) days, from which the mayor may appoint. In the event that no additional recommendations are made within ten (10) days, the mayor may appoint any applicant, in his discretion. The committee and mayor shall endeavor to appoint the best qualified person who meets at least the minimum standards for the position.

§ 23.003 PERSONNEL POLICIES AND PROCEDURES ADOPTED
   Personnel policies and procedures are hereby adopted by reference as if fully set out herein, and are on file in the office of the city clerk, as the same may be amended from time to time.

§ 23.004 SCHEDULE OF PERSONNEL POLICY CHANGES
   A schedule of personnel policy changes is set out in Tables of Special Ordinances, Personnel Policies and Procedures, Table 6.
§ 23.005 PENSION AND RETIREMENT PLAN ADOPTED
   (A)   There is hereby established and adopted the Berea Employees Capital Accumulation Plan. All eligible regular full-time officers and employees of the city are hereby authorized to participate in the plan.
   (B)   The terms of the Berea Employees Capital Accumulation Plan are set out in the adoption agreement between ICMA Retirement Corporation and the city, a copy of which is made a part hereof as if fully set out herein. The city council specifically adopts the plan and authorizes the mayor to execute the agreement on behalf of the city.
   (C)   Subject only to the provisions of the adoption agreement, the election of the city to participate in the ICMA Retirement Corporation Plan adopted herein may be revoked at a future time by action of the city council.

   (D)   The Berea Employees Capital Accumulation Plan is amended to allow employees access for the limited purpose of purchasing current service credit in the County Employees Retirement System as set out in § 23.006. The full text of the amendment is set out in the "First Amendment of Berea Employees Capital Accumulation Plan" and is on file in the office of city clerk.

§ 23.006 AUTHORIZATION FOR PARTICIPATION IN COUNTY EMPLOYEES RETIREMENT SYSTEM
   (A)   The city is hereby authorized to participate in the county employees retirement system effective November 1, 1992. All eligible regular full-time officers and employees of this agency are authorized and directed to comply with the statutory requirements of this retirement system.
   (B)   All employees of this agency whose duties require an average of one-hundred (100) hours during each working month are considered as regular full-time employees for county retirement purposes except those employees of agencies excluded which may participate in the system as a separate agency and those other persons who are employed as temporary, part-time, and seasonal workers, as defined in KRS 78.501(21).

ARTICLE II. CONTRACT POSITIONS
§ 23.010 CORPORATION COUNSEL
   There is hereby established the position of corporation counsel for the city, which shall be a contract professional with duties and authority as set out by contract.
