For the purpose of this chapter, the words and phrases defined in this section shall have the meaning set forth herein:
(a) "Pesticide" means:
(1) Any substance or mixture of substances intended for preventing, destroying, repelling or mitigating any pest;
(2) Any substance or mixture of substances intended for use as a plant regulator, defoliant or desiccant.
(b) "User of pesticides" means: any person who applies or causes pesticides to be applied to property or the atmosphere by any means where such person is engaged in applying pesticides for hire to trees, lawns, shrubs and plants.
(c) All other definitions set forth in the Ohio Pesticide Law, Ohio R.C. Chapter 921, are hereby adopted.

On or after July 1, 1988, no user of pesticides shall engage in the use or application of pesticides within the City limits without first registering in the Office of the Director of Public Service. A user of pesticides is subject to all conditions of this chapter and, in addition, shall provide proof of a current Ohio pesticide law license to be furnished at the time of registration.
Engaging in the use or application of pesticides without registering is a violation of this chapter.

Residents of Berea can register at anytime, and thereafter annually, on or before July first with the Building Department to have their name put on a list to be given to users of pesticides. All users of pesticides shall acquire such list from the Building Department on a quarterly basis beginning September 1, 1988, and give notice of an application of pesticides to each registered resident requesting same prior to such application. Notice shall consist of an oral or written prenotification to any resident registered to receive notice with regard to a specific address. If prenotification fails, the user of pesticides shall place a notice on the door of the home to be notified that such application has taken place.
