The Town of Beech Mountain seeks to protect the health and well-being of its employees. Since environmental tobacco smoke has been identified as potentially carcinogenic by the National Institute of Occupational Safety and Health and the Environmental Protection Agency, the Town of Beech Mountain hereby establishes a policy to regulate smoking. This policy shall apply to all employees and visitors on town property.

The Town Manager is empowered to prohibit smoking at other facilities during special events. The Town Manager shall have signs posted saying that smoking is prohibited at any event where he or she has banned smoking.

(A) Violation of this chapter by any person who shall subject the offender to a civil penalty in the amount of $100 to be recovered by the town. Violators shall be issued written notice of the violation which must be paid within ten days after receipt of said notice. If the violator does not pay the penalty within ten days, the town may recover such penalty and all subsequently accruing penalties in a civil action. In the event that it is necessary for the town to institute a civil action to collect such penalty, the violator shall be responsible for all court costs and attorneys' fees incurred by the town.
(B) Violation of this ordinance by any town employee may also result in disciplinary action being taken.
(C) Each violation of this section shall constitute a separate an distinct offense.
(D) This chapter may also be enforced by appropriate equitable remedies issuing from a court of competent jurisdiction.
