13-1-3: GENERAL REQUIREMENTS:

   (A)   The village engineer or other village representative as appointed by the president shall be responsible for fulfilling all of the duties listed in section 13-1-4 of this chapter.

   (B)   To fulfill those duties, the village engineer or other village representative as appointed by the president first should use the criteria listed in section 13-1-5, "Base Flood Elevation", of this chapter to determine whether the development site is located within a floodplain.

   (C)   Once it has been determined that a site is located within a floodplain, the village engineer or other village representative as appointed by the president must determine whether the development site is within a flood fringe, a designated floodway, or within an SFHA or floodplain for which no floodway has been identified.

      1.   If the site is within a flood fringe, the village engineer or other village representative as appointed by the president shall require that the minimum requirements of section 13-1-6 of this chapter be met.

      2.   If the site is within a floodway, the village engineer or other village representative as appointed by the president shall require that the minimum requirements of section 13-1-7 of this chapter be met.

      3.   If the site is located within an SFHA or floodplain for which no detailed study has been completed and approved, the village engineer or other village representative as appointed by the president shall require that the minimum requirements of section 13-1-8 of this chapter be met.

   (D)   In addition, the general requirements of section 13-1-9 of this chapter shall be met for all developments meeting the requirements of section 13-1-6, 13-1-7 or 13-1-8 of this chapter.

   (E)   The village engineer or other village representative as appointed by the president shall assure that all subdivision proposals shall meet the requirements of section 13-1-10 of this chapter.

   (F)   If a variance is to be granted for a proposal, the village engineer or other village representative as appointed by the president shall review the requirements of section 13-1-11 of this chapter to make sure they are met. In addition, the village engineer or other village representative as appointed by the president shall complete all notification requirements.

   (G)   In order to assure that property owners obtain permits as required in this chapter, the village engineer or other village representative as appointed by the president may take any and all actions as outlined in section 13-1-13 of this chapter. (Ord. 00-1075, 12-21-2000)
