7-16-3: ELEVATOR INSPECTOR; OATH AND BOND, DUTIES, POWERS:
   (A)   Oath And Bond: Before entering upon the duties of his office, the elevator inspector shall take and subscribe the oath of office and shall execute, acknowledge and deliver to the village a good and sufficient bond with two (2) or more sureties conditioned for the faithful discharges of his duties in his office. The bond shall meet with the approval of the village board.
   (B)   Duties: It shall be the duty of the elevator inspector to ensure compliance with all of the ordinances of the village relating to elevator equipment and to make such investigations and perform such duties as may be necessary in the enforcement of such ordinances.
   (C)   Powers: The elevator inspector is hereby authorized and empowered to enforce all ordinance provisions relating to elevator equipment. Said inspector is authorized and directed to do the following work on behalf of the village:
      1.   Stop Order: The elevator inspector shall have the power to order work stopped on the construction, alteration or repair of elevator equipment when such work is being done in violation of any ordinance or applicable code. The elevator inspector shall also have the authority to lockout the elevators in the event of nonconforming work or repair. Work shall not be resumed after the issuance of such a stop order except on written permission.
      2.   Employees Not Liable: Any employee charged with the enforcement of this chapter, acting in good faith and without malice for the village in the discharge of his duties, shall not thereby render himself liable personally and is hereby relieved from all personal liability for any damage that may accrue to persons or property as a result of any act required or by reason of any act or omission in the discharge of his duties. Any suit brought against any building official or employee because of such act or omission performed by him in the enforcement of any provisions of this chapter shall be defended by the legal department of the village until final termination of the proceedings.
      3.   Stop Work Notice: Whenever any elevator work is being done contrary to the provisions of this chapter, the enforcing officer may order the work stopped by notice, in writing, served on the contractor or persons doing or causing such work to be done, and any such person shall suspend such work until authorized by the enforcing officer to proceed with the work.
      4.   Reports: The enforcing officer shall prepare and submit all reports requested by the village board on any work covered by this chapter and shall incorporate in said report a summary of his recommendations as to desirable amendments to this code. (Ord. 02-1114, 4-18-2002)
