Generally storm sewers, manholes, catch basins and ditches in the right-of-way are constructed and maintained by the City and storm sewers and ditches from individual parcels are constructed and maintained by the property owner. Sometimes public sewers or ditches cross private land and are constructed and maintained by the City. The City shall only construct and maintain drainage where it owns the land or there is a recorded easement that gives the City the right to enter the land and do the work. The City Service Department shall:
(a) Develop a maintenance schedule and perform maintenance of the City drainage system.
(b) Make an inventory of storm detention systems existing in the City of Bedford when City Council passes a Storm Water Management Ordinance. Search records and collect original design information on the detention systems to established base information for future inspection.
(c) Add new storm water management facilities as they are constructed. All new facilities must be in an easement granting the Service Director the right to inspect the facility.
(d) Set a schedule to have each detention system inspected periodically. Permission to inspect will be voluntary for existing facilities with no inspection fee until such time as City Council passes an Ordinance requiring inspection.
(e) Provide an inspector who is certified for "Confined Space Entry" for detention facilities consisting of underground pipes.
(f) Provide for the cost of collecting records, setting schedules and inspecting facilities.
(g) Require a binding agreement in the form of an utility easement to be approved by the City Law Department between the owner/developer or other fiscally responsible agent or group and the City for the inspection and maintenance in perpetuity of all storm water management facilities of the plan. Agreement shall be recorded by the applicant at the County Recorders Office. The agreement shall include the following:
(1) Identify the responsible party for maintenance of storm water management facilities including cleaning outlet structures and channels.
(2) The prohibition of unauthorized alterations of structural and nonstructural storm water management facilities.
(3) Provide access for inspection by the Service Department Director or his assign.
(4) Upon finding a malfunction, structural failure or other threatening condition the responsible party shall be notified of the problem.
(5) Upon notification, the responsible party shall have two weeks to respond to the City with a plan for restoring the condition of the facility.
(6) The responsible party shall then have four weeks to restore the condition of the facility. If not completed, the City will make repairs and invoice the responsible party.
