When in the opinion of the Commissioner the termination before completion of a proposed excavation or fill operation would create an actual or potential hazard to the public, the Commissioner, prior to issuing the permit, shall require a bond in an amount sufficient to cover the estimated cost of restoration of any affected land or to cover the cost of performance of the operations under such permit, whichever is greater.
