No person, firm or corporation shall cause fill dirt and topsoil in excess of three (3) cubic yards to be moved from any lot within the City to a location outside the City without first having obtained a permit in writing from the City Manager, after paying ten dollars ($10.00). The City Manager shall not issue such a permit until he first ascertains that neither the City nor any other person is interested in purchasing the fill dirt for relocation within the City at a reasonable price. If the City Manager determines that the fill dirt is not needed within the City or that neither the City nor any other person is interested in the fill dirt being relocated within the City, then the City Manager shall grant such permit; otherwise, the permit shall be denied. As a condition precedent to obtaining such a permit, the applicant therefor must have suitable equipment for transporting the fill dirt safely through the City. No streets of insufficient weight bearing capability shall be used to transport the fill dirt and the trucks shall not be loaded in such a manner so as to spill out upon the streets.
