No permit shall be issued in any use district, for any structure other than a one, two or three-family dwelling or accessory structure, until the building plans have first been submitted to the Planning Commission. The Planning Commission shall review, recommend and study the plans to determine whether the plans are in conformity with all applicable State and municipal laws and to determine whether the shape, appearance, size or design of the building will have a substantial and adverse effect on property values or historical significance in the area where the improvement is to be made. The Planning Commission is authorized to use a licensed architect where necessary to be selected by the City Manager, so that the Commission may approve, conditionally approve or disapprove the building plans and any such order shall be in writing. The applicant for the building plans may appeal any condition in a conditional approval or disapproval to Council by making a written demand for a hearing. He shall file such demand with the Clerk of Council or City Manager but such notice of appeal must be made within ten (10) days after delivery of the notice to the applicant or his authorized agent. Any such notice shall advise the applicant that the notice of appeal must be made within ten (10) days as hereinabove provided. Council may either approve, disapprove or modify the decision of the Planning Commission or refer it back to the Commission or any other Board or agency for further proceedings.
