(a) Cable Television Franchise Required. No Cable Operator shall provide Cable Service within the City without first securing from the City a nonexclusive franchise.
(b) Cable Television Franchise Expiration.
(1) In the event a franchise expires by its terms, the franchise shall be automatically renewed on a month-to-month basis until terminated by either party in accordance with law.
(2) At the expiration of the franchise or upon revocation of the franchise, the City may, in lawful manner and upon the payment of fair market value, determined on the basis of the cable television system as valued as a going concern exclusive of any value attributable to the franchise itself, lawfully obtain, purchase, condemn, acquire, takeover and hold the cable television system.
(c) Institutional Network. In consideration for all rights granted by the City in a cable television franchise agreement or incidental to grantee under the franchise agreement, any cable television franchise shall include a provision for an institutional network to provide high-speed transmission of data, voice and video among and between the City's government, school and library buildings. The institutional network shall include the capacity to transmit information between the institutions serviced by the network and the subscribers to the cable television system. In the event an institutional network has already been provided by another franchisee, or from some other source, the City may negotiate to receive monies, equipment and/or services in place of providing all or part of an institutional network.
(d) Cable Television System Capacity. No cable television operator shall build its system beyond the capacity necessary to provide cable television or institutional network service without obtaining express permission from the City and securing a Use Permit hereunder. The City's permission shall not be unreasonably withheld.
