739.22 PHYSICIAN QUALIFICATIONS AND RECORDS; PHYSICIAN IN CHARGE OF ABORTION.
   (a)   An abortion service shall be staffed so as to provide, on the premises, adequate medical, nursing and ancillary personnel.
   (b)   The abortion shall be performed by a physician in charge who shall be a qualified obstetrician/gynecologist as previously defined.
   (c)   The physician in charge of the abortion shall be responsible for:
      (1)   Setting the policies and procedures pertaining to abortions and the implementation thereof:
      (2)   Designating a licensed physician or physicians whom he/she deems qualified to perform abortions and to supervise directly the care of all patients undergoing abortion, including their post-operative care and follow-up;
      (3)   Establishing standards for the observation of patients by nursing personnel during the post-operative period.
   (d)   A qualified obstetrician shall be present on the premises of the abortion facility at all times during the operative and post-operative period.
   (e)   The physician in charge of the abortion shall have admitting privileges at the nearest hospital.
   (f)   A qualified anesthesiologist or anesthetist shall be on staff and, when medically indicated, shall participate in the selection of the most appropriate anesthetic agent to be used and shall be present to supervise or actually administer the anesthetic when procedures are undertaken which require such participation.
   (g)   The facility shall maintain a record of the educational training and experience background of each person granted privileges to perform surgery in a facility.
