717.03 CONSTRUCTION REQUIREMENTS.
   No proprietor or person shall keep roomers or conduct or keep a rooming house, foster home or hotel unless the premises and rooms so used shall comply with the following requirements:
   (a)   Minimum Area and Volume. Each sleeping room shall have a minimum floor area of eighty square feet (80 sq. ft.), a minimum height for one-half of its floor area of seven and one-half feet (7-1/2 ft.), a minimum volume of six hundred forty cubic feet (640 cu. ft.) and a minimum volume per occupant of any such room of four hundred cubic feet (400 cu. ft.).
   (b)   Space Restrictions. Rooms shall not be rented to roomers or used for rooming house, foster home or hotel purposes in such number that the remaining rooms used for sleeping purposes by any family on the premises shall have a volume of less than four hundred cubic feet (400 cu. ft.) per person.
   (c)   Bathrooms Required. A room shall not be rented by a family to a roomer unless the family has the exclusive use of at least one bathroom equipped with toiled, lavatory, bathtub or shower, which bathroom or bathrooms it proposes to share with such roomer.
   (d)   Minimum Bathroom Facilities. The premises must be provided with a bathroom equipped with toilet, lavatory and bathtub or shower for each six (6) persons or fraction of such number of persons living in the premises, including roomers, employees and members of the family.
   (e)   Windows. Each room shall be provided with one or more windows to the outside having a total glass area equal to at least ten percent (10%) of the floor area and constructed so as to permit one or more windows being open for one-third (1/3) of this area, which windows shall be adequately screened from May 1 to October 31 of each year.
   (f)   Third Floor Rooms. No room located on the third (3rd.) floor of any dwelling shall be used for roomers or for rooming house or foster home purposes unless approved by the City Manager and approved as to means of egress by the Building Commissioner or Building Inspector. In no event shall the total number of occupants of such third floor (3rd.) exceed three (3) persons including roomers, foster children, families and employees.
   (g)   Cellar and Basement Rooms. No room located in a cellar or basement as herein defined shall be used for roomers or for rooming house, foster home or hotel purposes unless approved by the City Manager.
   (h)   Means of Egress. The means of egress to the outside of the premises from any room shall meet with the approval of the Building Commissioner or Building Inspector and shall at all times be kept clear of obstructions. Any door which must be used in connection with such means of egress shall be provided with a lock which can be opened from the inside without the use of a key.
   (i)   Maintenance. The building shall be kept in good repair and in accordance with the ordinances and regulations of the City as to plumbing and sewerage; heating, including chimneys, flues, furnaces, fireplaces, stoves and similar equipment; electrical work, including wiring, conduit, outlets and equipment connected therewith; roofs, gutters and downspouts, and regulations as to the keeping of ashes, rubbish, paper, burnables and garbage in suitable containers. The building and premises shall be kept In a clean, orderly and sanitary condition.
   (j)   Heating. Each room or occupied space shall have heat furnished or shall be supplied with an approved means of heating so that a minimum temperature of sixty-eight (68) degrees Fahrenheit can be maintained between the hours of 6:30 a.m. and 11:00 p.m., Bedford time. For the purpose of determining whether or not the temperature in any such room or occupied space is in accordance with the provisions of this section, temperature readings shall be made by means of a standard Fahrenheit thermometer at a point not less than four feet (4 ft.) nor greater than six feet (6 ft.) above the floor.
   (k)   Cooking in Rooms. The existence or use of hot plates or other facilities for cooking is prohibited in any rooms rented to a roomer.
