(a) Upon receipt of the certificate of the Health Officer that the massage establishment is in compliance with all applicable regulations, and the certificate of the Building Inspector and the Fire Inspector that the building meets the requirements of the Building Code and the fire prevention regulations, respectively, and the certificate of the Chief of Police that the applicant or applicants have not been convicted in a court of competent jurisdiction of the crimes listed in division (a)(2), the Chief of Police shall issue a permit to maintain, operate or conduct a massage establishment, unless he or she finds:
(1) That the operation, as proposed by the applicant, if permitted, would not have complied with all applicable laws of the City;
(2) That the applicant and any other person who will be directly or indirectly engaged in the management and operation of a massage establishment has been convicted of a felony; an offense involving sexual misconduct with children; prostitution; soliciting for purposes of prostitution; pandering; keeping a place of prostitution; pimping; any crime involving dishonesty, fraud or deceit; or any other offense opposed to decency and morality; within the last five (5) years.
(b) Every massage establishment permit issued pursuant to this chapter will terminate at the expiration of one (1) year from the date of its issuance, unless sooner suspended or revoked.
