(a) Required. It is hereby determined that a curfew for juveniles in the City, regulating their activities at night, is required.
(b) Loitering in Public Places. No minor of the ages specified in subsection (c) hereof, during the hours specified therein, shall loaf, loiter, wander, stroll or play in, upon or about any public street, highway, alley, park or other public place or public land, or ride aimlessly on or about any public street, highway, alley, park or other public place or public land in any vehicle, or enter upon or be found upon the property of another, without invitation, in the City.
(c) Parent's Permission; Hours Specified. No minor, during the hours hereinafter specified, shall be in, upon or about any public street, highway, alley, park or other public place or public land, unless such minor is accompanied by the minor's parent, guardian or legal custodian, or unless such minor is in the performance of an errand or duty directed by the minor's parent, guardian or legal custodian, or is going to or returning from a church or school function or event or any other place with the express permission of such minor's parent, guardian or legal custodian, but no such permission shall include those acts prohibited in subsection (b) hereof.
The prohibited hours for age groups are:

(d) Police Investigation and Action. No parent, guardian or legal custodian of a minor of an age specified in subsection (c) hereof shall permit or encourage such minor to be in or upon any public street, highway, alley, park or other public place in violation of this section.
Whenever any police officer of the City finds any minor in violation of this section, such officer shall make an immediate investigation. If he finds probable cause to believe that the presence of such minor is in violation of this section, such officer shall cause the minor to be taken to the police station to be held until released according to law and a citation shall thereupon be served upon the minor and/or his parent, guardian or legal custodian for violation of this section. If the police officer has reasonable and probable cause to believe that the parent, guardian or legal custodian has violated this section, such officer shall sign an affidavit and commence prosecution according to law.
(e) Hours of Property Use Signs. The City Manager shall post signs on City owned or leased property regulating its hours of use and any other governmental body may post its property regulating hours of use. Any person who violates such sign restrictions shall be deemed a trespasser and may be prosecuted under Section 541.05.
(f) Penalty. Whoever violates section (d) hereof is guilty of a minor misdemeanor for a first offense. A second offense shall be punishable as a fourth degree misdemeanor. A third and subsequent offense shall be punishable as a first degree misdemeanor.
