1717.16 MAINTENANCE OF STORMWATER FACILITIES.
   (a)   Private stormwater facilities located in private property and within the service area shall be maintained by the owner or the responsible party and shall be repaired and/or replaced by such person when such facilities are no longer functioning as designed.
   (b)   Any projects 5000 feet or greater shall develop a maintenance agreement and maintenance plan with the VOB approved stormwater facilities. A draft agreement and plan shall be provided to the VOB during the review process. The executed and recordation information at the Cabell County Record Office of the maintenance agreement and plan shall be provided to the VOB prior to any permits being issued to proceed with Construction.
   (c)   Disposal of waste from maintenance of private facilities shall be conducted in accordance with applicable federal, state and local laws and regulations.
   (d)   Records of installation and maintenance and repair shall be retained by the owner or other responsible party for a period of five (5) years and shall be made available to the VOB upon request.
   (e)    The VOB may perform corrective or maintenance work, which shall be at the owner's expense, upon any failure to maintain facilities or correct problems with facilities after receiving due reasonable notice from the Director.
   (f)    Routine maintenance of detention/retention facilities shall be conducted by the owner of the facility in accordance with this article and guidance of the VOB.
