(a) The procedures for grading plan reviews, foundation checks and final grade checks, as set forth in subsection (b) hereof, are hereby adopted for any construction requiring an occupancy permit.
Copies of the site plan, attached as Exhibit B to original Ordinance 78-89, passed September 25, 1989, shall be provided to builders as a sample to show what is required on a grading plan.

(b) Procedures for grading plan reviews, foundation checks and final grade checks shall be as follows:
(1) All communication shall flow through the Building Inspector.
(2) Upon application for a building permit, the Building Inspector shall forward three copies of the grading plan to the Consulting Engineer for review and comment.
(3) Within ten working days, the Consulting Engineer shall review the grading plan and forward written comments or oral approval. Upon approval, the Building Inspector may issue a building permit, provided all other requirements have been satisfied.
(4) The Building Inspector shall request a foundation check from the Consulting Engineer or another registered surveyor. The surveyor shall certify the foundation elevation in MSL (mean sea level) value.
(5) No framing shall begin until the foundation elevation has been certified by the Consulting Engineer or another registered surveyor.
(6) Upon receipt of an application for an occupancy permit, the Building Inspector shall request a grade inspection from the Consulting Engineer. The Consulting Engineer shall respond within two weeks with written comments or oral approval.

(a) The Standard Construction Drawings and Out-Parcel Construction Drawings, which are attached to Ordinance 65-14, passed June 9, 2014, as Exhibit A (amended by Ordinance 48-19, passed August 12, 2019 and amended by Ordinance 50-21, passed August 9, 2021), and which are hereby made a part hereof by reference, are hereby adopted.
(b) The Standard Construction Drawings and Out-Parcel Construction Drawings shall be kept on file with the Building Department and the Utility Department to be used and enforced as standards and specifications required by this section.

(a) Unless another penalty is expressly provided, the owner of any building or structure, or any part thereof, where anything in violation of any of the provisions of this Building and Housing Code is done or exists, and any architect, builder, plumber, carpenter, mason or other person who or which may be employed to assist in such work and who or which violates any of the provisions thereof, or who or which violates or fails to comply with any order or regulation made thereunder, or who or which builds in violation of any detailed statement of specifications or plans submitted and approved thereunder, or any certificate or permit issued thereunder, are severally, for each and every violation and noncompliance respectively, guilty of a misdemeanor of the third degree and shall be fined not more than five hundred dollars ($500.00) or imprisoned not more than sixty days, or both, for each offense. A separate offense shall be deemed committed each day during or on which a violation or noncompliance occurs or continues, unless otherwise provided.
(b) The imposition of such penalty for any violation or noncompliance shall not excuse the violation or noncompliance or permit it to continue, and all persons shall be required to correct or remedy such violation or defect within a reasonable time. The imposition of such penalty shall not be held to preclude the enforced removal of prohibited conditions or the application of any other equitable remedy.
