1440.05 CHANGES ORDERED BY BUILDING INSPECTOR.
   The Building Inspector is hereby authorized, after inspection, to direct such changes in the supports, floors, columns, walls, doorways, fire escapes, etc., as from his or her examination he or she deems necessary to ensure the safety of persons, the building or structure or adjoining property.

1440.06 FAILURE TO COMPLY WITH CHANGES ORDERED; REMEDY OF CITY.
   If an owner, agent or person in possession, charge or control of a building or structure or part thereof, when so directed, fails, neglects or refuses to place such building or structure or part thereof occupied by him or her, or under his or her control, in a safe condition, and to adopt such measures as have been specified by the Building Inspector within a reasonable time, then the Building Inspector may cause such building to be vacated, preventing the use of such building for any purpose whatever, until the same is placed in a safe condition by the owner. If such building or structure is dangerous to adjoining property, the Building Inspector may order or cause such work to be done as may be necessary to remove the existing danger, charging the expense of such operations upon the tax duplicate as a lien against such property.

1440.07 DUTIES OF BUILDING INSPECTOR.
   The Building Inspector is hereby charged with the examination and inspection of buildings and structures, with the enforcement of all provisions of this Building and Housing Code, and with all other laws and ordinances relating to the erection, construction, alteration, repair, addition to, raising or moving of, change in the nature of use or occupancy of, and safety of buildings, structures, elevators, heating apparatus, gas fitting, electric wiring, house drainage and plumbing, boilers, fire escapes, stairways, exits and fire protective construction and devices. He or she shall decide questions relating to the strength of buildings and structures and the quality of all structural material. He or she shall approve, or cause to be approved, all plans and specifications submitted before a permit for any construction purpose is issued, and when such plans and specifications comply with lawful requirements, he or she shall issue the required permit. He or she shall cause the prosecution of any person violating any of the building regulations of the City.

1440.08 RECORDS AND REPORTS.
   The Building Inspector shall keep, or cause to be kept, in a proper filing system, records of the location and character of every building operation for which a permit is issued, and shall keep a record of all inspections and reports made.
   The Building Inspector shall submit to the Mayor and Council a monthly report, on or before the tenth day of each month, showing the character, number and fees of all permits issued during the preceding month.
   The Building Inspector shall make an annual report to the Mayor and Council, on or before January 21 of each year, showing the character, number and fees of all permits issued during the preceding calendar year.

1440.09 INSPECTION OF GRADING AND FOUNDATIONS.
   (a)   The procedures for grading plan reviews, foundation checks and final grade checks, as set forth in subsection (b) hereof, are hereby adopted for any construction requiring an occupancy permit.
   Copies of the site plan, attached as Exhibit B to original Ordinance 78-89, passed September 25, 1989, shall be provided to builders as a sample to show what is required on a grading plan.

   (b)   Procedures for grading plan reviews, foundation checks and final grade checks shall be as follows:
      (1)   All communication shall flow through the Building Inspector.
      (2)   Upon application for a building permit, the Building Inspector shall forward three copies of the grading plan to the Consulting Engineer for review and comment.
      (3)   Within ten working days, the Consulting Engineer shall review the grading plan and forward written comments or oral approval. Upon approval, the Building Inspector may issue a building permit, provided all other requirements have been satisfied.
      (4)   The Building Inspector shall request a foundation check from the Consulting Engineer or another registered surveyor. The surveyor shall certify the foundation elevation in MSL (mean sea level) value.
      (5)   No framing shall begin until the foundation elevation has been certified by the Consulting Engineer or another registered surveyor.
      (6)   Upon receipt of an application for an occupancy permit, the Building Inspector shall request a grade inspection from the Consulting Engineer. The Consulting Engineer shall respond within two weeks with written comments or oral approval.

1440.10 ADOPTION OF STANDARD CONSTRUCTION DRAWINGS AND OUT-PARCEL CONSTRUCTION DRAWINGS.
   (a)   The Standard Construction Drawings and Out-Parcel Construction Drawings, which are attached to Ordinance 65-14, passed June 9, 2014, as Exhibit A (amended by Ordinance 48-19, passed August 12, 2019 and amended by Ordinance 50-21, passed August 9, 2021), and which are hereby made a part hereof by reference, are hereby adopted.
   (b)   The Standard Construction Drawings and Out-Parcel Construction Drawings shall be kept on file with the Building Department and the Utility Department to be used and enforced as standards and specifications required by this section.

1440.99 PENALTY; EQUITABLE REMEDIES.
   (a)   Unless another penalty is expressly provided, the owner of any building or structure, or any part thereof, where anything in violation of any of the provisions of this Building and Housing Code is done or exists, and any architect, builder, plumber, carpenter, mason or other person who or which may be employed to assist in such work and who or which violates any of the provisions thereof, or who or which violates or fails to comply with any order or regulation made thereunder, or who or which builds in violation of any detailed statement of specifications or plans submitted and approved thereunder, or any certificate or permit issued thereunder, are severally, for each and every violation and noncompliance respectively, guilty of a misdemeanor of the third degree and shall be fined not more than five hundred dollars ($500.00) or imprisoned not more than sixty days, or both, for each offense. A separate offense shall be deemed committed each day during or on which a violation or noncompliance occurs or continues, unless otherwise provided.
   (b)   The imposition of such penalty for any violation or noncompliance shall not excuse the violation or noncompliance or permit it to continue, and all persons shall be required to correct or remedy such violation or defect within a reasonable time. The imposition of such penalty shall not be held to preclude the enforced removal of prohibited conditions or the application of any other equitable remedy.
