925.02 FEES FOR PERMIT.
   (a)   The Director of Engineering, Utilities and Inspection, or his duly authorized assistant, shall not issue a permit for the purpose described in Section 925.01 hereof, until the applicant for such permit shall have deposited in cash, or by certified check payable to the City, a utilization charge to be calculated by adding together the following:
      (1)   $4,413.00 for each demand unit as determined in accordance with subsection (b) hereof.

      (2)   The cost of the water meter and other material provided by the City to effectuate a connection between the building or structure and the system, the cost of inspection of such connection, and the direct or indirect costs of labor provided by the City with respect to such connection, all as to be reasonably determined from time to time by the Director of Engineering, Utilities and Inspection and set forth in regulations issued by such Director, plus (Ord. 1979-71.       (3)   Local fair share water line charge of $94.00 per linear foot of front property or if the construction of the main water line was within three years of the date of assessment, and the cost of actual construction was less than fifty-eight dollars and fifty cents ($58.50) per linear foot then the lower cost will be assessed, EXCEPTION, if the water line was constructed and was available for laterals to be connected prior to June 28th, 1999, then the local fair share water line charge of eleven dollars ($11.00) per linear foot of front property shall be assessed. This assessment is made if the water line exists and the water line has not been previously assessed to the property or installed at a developer’s expense.

   (b)    As used in paragraph (3) of subsection (a) hereof, front foot means frontage which abuts on the street right of way and for corner property it shall be the shortest frontage so abutting. When the property to be served does not abut upon a street right of way, front foot shall mean the width of the parcel. Further, as used in paragraph (1) of subsection (a) hereof, the term "demand unit" represents a building, apartment, living unit or other structure which is connected, directly or indirectly, to the system by means of a 3/4" service line or water meter. For purposes of calculating the portion of the total utilization charge provided for in paragraph (1) of subsection (a) hereof, in the case of connection, directly or indirectly, to the system utilizing a service line or water meter in excess of three-quarters of an inch, the following factors shall be applied: (Ord. 1979-71.       (1)    1" service line or water meter is the equivalent of 1.4 demand units; (Ord. 1994-184. Passed 12-5-94. )
      (2)    1-1/2" service line or water meter is the equivalent of 2.7 demand units;
      (3)    2" service line or water meter is the equivalent of 4.1 demand units;
      (4)    3" service line or water meter is the equivalent of 8.2 demand units;
      (5)    4" service line or water meter is the equivalent of 12.3 demand units;
      (6)    6" service line or water meter is the equivalent of 18.4 demand units;
      (7)    8" service line or water meter is the equivalent of 36.7 demand units. (Ord. 1993-34. Passed 3-24-93.)
   In the event the service line or water meter exceeds the sizes or differs from those specified above, the Director of Engineering, Utilities and Inspection shall, on the basis of accepted engineering practices and the equivalent factors set forth herein, determine the equivalent demand units of such service line or water meter.
   (c)    The utilization charges set forth in this section shall be subject to adjustment by Council following recommendations by the Director of Engineering, Utilities and Inspection based on changes in costs of constructing or acquiring extensions and improvements to the system.
   (d)    In the case of a connection, directly or indirectly, to the system for the purpose of providing a supply of water for fire protection purposes only, and not for domestic use, there shall be paid to the City an amount which is the aggregate of the cost of the water meter and other material provided by the City to effectuate such connection, the cost of inspection of such connection and the direct or indirect costs of labor provided by the City with respect to such connection, all as to be reasonably determined from time to time by the Director of Engineering, Utilities and Inspection and set forth in regulations issued by such Director. The charges provided for in this section shall be paid to the Director of Finance and credited to the operating fund established for the system.
   (e)    Any such utilization charge or charge provided for in subsection (d) hereof, not paid in full at the time of the connection shall be certified by the Director of Engineering, Utilities and Inspection to the County Auditor, who shall place the same upon the real property tax list and duplicate against the property serviced by such connection and such charge shall be a lien on such property from the date the same are placed in the real property tax list and duplicate by the Auditor and shall be collected in the same manner as other taxes.
