917.05 FAILURE TO COMPLY.
    (a) If any owner or occupant or real property located within the corporate limits of the City fails to comply with Section 917.02 of this Chapter between the 1st day of May through the 1st day of November of each calendar year, such condition is hereby found and declared to be a public nuisance. The City Manager or designee may enter upon such property and abate said nuisance by causing weeds, vines and grass as defined in Section 917.01 to be cut and properly disposed of at the owner's expense and cost, together with an administrative fee as set forth below. Prior to entering upon such property, the Manager or designee shall give written notice of the violation to the owner or occupant by personal delivery or, if personal delivery is impracticable, by leaving the same at such property in a conspicuous place. The notice shall advise the owner or occupant of the violation; give a reasonable time, which shall not be less than 72 hours, for correction of the condition; and shall state that if the condition is not corrected within such time that the City may proceed as aforesaid. The notice shall further indicate that the City may remedy future violations during the same growing season without further notice if the owner or occupant continues to fail to comply, and that each entry and remediation shall result in the imposition of the charges and administrative fees set forth below.
 
   (b) The fee for abating the public nuisance in accordance with this chapter shall be billed by the City Auditor's Department at a rate of one hundred fifty dollars ($150.00) per hour with a minimum charge of one hundred fifty dollars ($150.00), plus the administrative fee set forth below. In the event the City is required to employ outside services for such abatement work, the fee shall be the actual cost of such contract, plus the administrative fee set forth below.
 
   (c) The administrative fee referenced above shall be as follows: For a first cutting two hundred and fifty dollars ($250.00); and for a subsequent cutting within a growing season, five hundred dollars ($500.00).
