§ 92.99  PENALTY.
   (A)   Any person violating any provision of this chapter for which no specific penalty is prescribed shall be subject to § 10.99 of this code of ordinances.
   (B)   (1)   In addition to the remedies provided in §§ 92.05(A), 92.07, 92.08, 92.09, 92.11 and 92.12 of this chapter, whoever violates any term, condition or provision of §§ 92.01 through 92.12 of this chapter shall be subject to the following penalties: whoever shall violate or fail to comply with any of the provisions of §§ 92.01 through 92.12 of this chapter, or shall violate or fail to comply with any order or regulation made thereunder, shall be fined not less than $5, nor more than $2,500.
      (2)   The payment of a penalty shall not excuse the violation or permit it to continue, nor shall such payment be held to prevent the enforced correction of the prohibited conditions by legal and injunctive remedies in a court of law or equity.
      (3)   A separate offense shall be deemed committed upon each day during or on which such violation occurs or continues.

   (C)   (1)   If any order for removal of a junk vehicle is not obeyed within the time period fixed in §§ 92.25 through 92.30 of this chapter, the owner of the junk vehicle and the occupant and the owner of the real estate upon which said junk vehicle is located shall each, upon conviction, be punished with a minimum fine of $50 and a maximum fine of $500 for each violation. A separate violation of §§ 92.25 through 92.30 of this chapter shall be deemed committed on each day during which the junk vehicle is permitted to remain on the real estate after the time fixed in said order.
      (2)   In addition to the penalties provided in division (C)(1) above, the town is empowered to bring a civil action to enjoin any person from violating any section, provision or condition of §§ 92.25 through 92.30 of this chapter.

   (D)   Whoever shall be found to be keeping and/or maintaining a common nuisance pursuant to § 92.49 of this chapter shall be fined not less than $5, nor more than $500, plus costs. A separate offense shall be deemed committed upon each day during or on which such violation occurs or continues. In addition, the town may seek injunctive relief in a court of law and/or equity to enforce the terms and provisions of §§ 92.45 through 92.49 of this chapter.
