§ 71.99  PENALTY.
   (A)   Any person violating any provision of this chapter for which no specific penalty is prescribed shall be subject to § 10.99 of this code of ordinances.
   (B)   (1)   Operators of golf carts are subject to citations for violations of any provision of §§ 71.01 through 71.07 of this chapter.
      (2)   Violations by the owner or operator of any provision of §§ 71.01 through 71.07 of this chapter may be cause for revocation or suspension of the owner’s permit for the golf cart. It shall be the sole determination of the town’s Police Department whether any violation or a series of violations constitutes a revocation or suspension and the duration of said action.
      (3)   In addition to the penalty provided in division (B)(1) above, any person, firm or corporation who violates any provision of §§ 71.01 through 71.07 of this chapter may be prosecuted in court and shall, upon conviction, be punished with a minimum fine of $50 and a maximum fine not exceeding $2,500. A separate offense shall be deemed committed upon each day during which a violation occurs or continues.
      (4)   In addition to the penalties provided in divisions (B)(1) and (B)(2) above, the town is empowered to obtain a restraining order and/or a permanent injunction against any person, firm, corporation or any other entity that show to be in violation of §§ 71.01 through 71.07 of this chapter. A person against whom the town recovers a judgment shall pay costs of the court action and the town’s attorney’s fees.
   (C)   (1)   Any person, upon conviction for a first or second violation of §§ 71.20 through 71.23 of this chapter, shall be liable for a fine up to $100 for each such violation.

      (2)   Any person, upon conviction for a third or subsequent violation of §§ 71.20 through 71.23 of this chapter, may be liable for a fine up to $500.

   (D)   Any person who violates any provision of §§ 71.35 through 71.41 of this chapter shall, upon conviction, be punished with a minimum fine of $10 and a maximum fine of $200, in addition to costs. Each incident shall constitute a separate violation under §§ 71.35 through 71.41 of this chapter.
