For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
ASSOCIATION. A partnership, limited partnership or any other form of unincorporated enterprise, owned by two or more persons.
CANVASSER or SOLICITOR. Includes the practice of going from house to house or place to place in the township selling, causing to be sold, offering for sale or taking orders for present or future delivery of merchandise or services. It shall also be deemed to include surveys for research purposes, analyses, opinion polls, rating data, contributions, donations or alms for any person or organization and any person or organization and any such similar work which of its nature involves a house to house or place to place activity.
CORPORATION. Any corporation or joint-stock association organized under laws of the United States, the Commonwealth of Pennsylvania or any other state, territory, foreign country or dependency.
FIRM. The members of a business organization that owns or operates one or more establishments.
PERSON. Every natural person, firm, corporation or association. Whenever used in any clause prescribing and imposing a fine or imprisonment or both, the word PERSON as applied to firms or associations shall mean the partners or members thereof and, as applied to corporations, the officers thereof.
TRANSIENT MERCHANT. Any person who occupies a room, apartment, store, shop, building, trailer, tent or other temporary structure for the exhibition or sale of goods, wares or merchandise with the intention of remaining less than 90 days. Said term shall include a participant as a vendor in a flea market. Temporary sales of Christmas trees, Easter flowers, Mother’s Day flowers and the like shall be considered as TRANSIENT in nature and therefore under the regulations of this chapter.

It shall be unlawful for any person, firm, corporation or association whether by principal or agent, to sell or offer for sale or otherwise solicit orders, either on the public streets, public places, private property or from house to house within the township, any goods or merchandise or services of any kind whatsoever, or to solicit orders for any of the same, without first having completed an application, paid the required fee and obtained, from the Secretary-Treasurer of the township, a license for such purpose. The license required under this section shall be required of each and every separate canvasser, solicitor or transient merchant, including, but not limited to, instances in which multiple canvassers, solicitors or transient merchants shall operate in or on the same location, route, room, apartment, store, shop, building, trailer tent or other structure.

(A) Information required for the issuance of a license:
(1) The name, age and physical description of applicant and each such agent and/or employee;
(2) Complete permanent home and local address of applicant and his or her agents or employees;
(3) The applicant must submit proof of registration for commonwealth sales/use tax or sufficient demonstration that such registration is not required;
(4) Name and address of organization or person for whom the canvass or solicitation is being made, or, if a corporation a copy of articles of incorporation and certification of Federal Income Tax I.D. number;
(5) Description of the nature of the canvass or solicitation, or a description of the purpose or causes for which the canvass or solicitation is being made; and
(6) The make, model, year, color and license plate number of automobiles used by the applicant, agents and/or employees during the period of canvassing or solicitation within the township and the numbers of their drivers, licenses and state of issuance.
(B) Display of license required:
(1) Every transient merchant, shall, at all times while engaged in the sales of merchandise in the township, display the license at their location of sales. The license shall be located in a conspicuous location and visible to the public, or other enforcement officers of the township; and
(2) Every canvasser or solicitor shall, at all times while engaged in canvassing or soliciting in the township, carry such license upon his or her person, and shall present said license upon request of any resident, or other enforcement officers of the township.
