5-6-4: PENALTIES:
   A.   Any person violating the provisions of this chapter shall be subject to the following penalties, to be paid in the Village Office of Collections:
      1.   Upon detection of the first nuisance violation, the owner and/or tenant of the real estate shall be issued a notice of the violation(s) and shall be issued a warning ticket. The owner of the property is required to abate the violation(s) within seven (7) days of the date of the warning ticket.
      2.   Upon detection of any second violation during any consecutive twelve (12) month period of the issuance of the first nuisance violation, or for failure to abate the previous violation within a seven (7) day period or appeal said alleged nuisance violation within said time, the owner of the real estate shall be issued a notice of violation and shall pay a penalty of twenty five dollars ($25.00). In the event the penalty is not paid in seven (7) days from the date of the notice, the owner of the real estate shall pay as the penalty the sum of fifty dollars ($50.00).
      3.   Upon detection of any third or subsequent violation during this consecutive twelve (12) month period, the owner of the real estate shall be issued a notice of violation and shall pay a penalty of fifty dollars ($50.00). In the event the penalty is not paid in seven (7) days from the date of the notice, the owner of the real estate shall pay as the penalty the sum of one hundred dollars ($100.00).
      4.   Failure of the person violating the provisions of this chapter to pay the above listed penalties will result in the chief building inspector/Chief of Police instructing the Village Attorney to seek fines and other remedies in court. Fines are to be a minimum of twenty five dollars ($25.00) per occurrence and a maximum of one hundred dollars ($100.00) per occurrence.
      5.   An appeal of any alleged violation of this chapter may be filed with the Village President in writing no later than seven (7) days from the date of the notice. Results of this appeal will be sent in writing within seven (7) days of the receipt of the appeal. No further penalties will be assessed during this appeal process. (Ord. 380, 5-8-2018)
