REGULATION OF PRIVATELY OWNED TREES AND PLANTS
It is hereby declared to be the intent and purpose of this division to provide for clear and unimpeded use and view of the streets, avenues, alleys, and sidewalks within the city by vehicular and pedestrian traffic. For the furtherance of such intent and purpose, it is declared to be the duty and obligation of the owner or occupant of any real estate within the city to maintain trees, shrubs, or bushes growing along or adjacent to any such street, avenue, alley, or sidewalk, and whether in the parkway or otherwise, in such condition as not to interfere with such clear and unimpeded use or view.

To accomplish the declared intent and purpose of this division, no tree shall be permitted to overhang such street, avenue, alley, or sidewalk lower than 12 feet as to the street, avenue, or alley and eight feet as to the sidewalk, and it shall be the duty of such property owner or occupant to so trim such trees to conform to the provisions of this article.

(A) In the event any such owner or occupant shall fail, refuse, or neglect to so trim such trees within ten days after service of a notice to do so, the city, by and through its agents, servants, and employees, may go upon the premises and trim the trees and other vegetation growing thereon to conform to the provisions hereof, and the costs and expenses incident thereto may be recovered in a proper civil action instituted by the city against the owner or occupant of the premises.
(B) The notice herein provided for shall be issued under the hand of the City Clerk and be served by the Police Department upon the person to whom the same is directed.
