4-1-10: EXCLUSIONS AND REDUCTIONS:
   A.   The terms and provisions of this chapter shall not be made applicable to any activity carried on or operated by a governmental institution and the fee established in section 4-1-6 of this chapter shall be reduced by one-half (1/2) for any not for profit institution or organization.
   B.   From time to time the city council, by majority vote on a resolution, may exempt the payment of the fee established in section 4-1-6 of this chapter for certain specified not for profit institutions or organizations, where the city council makes a finding that the essential character of the specified institution or organization is charitable in nature and that the particular activity related by this title shall be conducted in the best interest of the citizens of the city and that such activity when considered in light of the purposes of such institutions or organizations tends to promote the health, safety or welfare of the community.
   C.   The terms and provisions of this title shall not be made applicable to any activity which the state has declared to be within the exclusive regulation of the state. (Ord. 4364, 10-25-1978, eff. 1-1-1979)
