(a) It shall be the general policy of the City to minimize the increase in stormwater runoff from any property as a result of changing the surface conditions of the property. All development both residential, commercial and industrial shall comply with the City’s stormwater drainage regulations.
(b) The Director of Public Service shall conduct a periodic review of the regulations governing the quality and quantity of stormwater discharged from properties in the City and revise accordingly. The intent of the regulations shall be to minimize the instantaneous rate of stormwater runoff from increasing as a result of physical changes to the property.
(c) The Director of Public Service shall publish in the local newspaper a notice of new or modified stormwater regulations. The notice shall include the subject matter of the proposed regulations, where copies can be obtained and reviewed, where comments concerning the proposed regulation can be submitted and the deadline for submitting comments. The comment period shall be no less than thirty days. After receiving and evaluating the comments, the Director of Public Service may modify the proposed regulations and the final regulations. The final regulations become effective when a notice is published in the newspaper.
(d) General Policies.
(1) Stormwater drainage facilities shall be designed with the capacity to collect and transport the stormwater from the property and the entire tributary area through the property at the design storm. The property owner shall be responsible to construct all required collection, transportation and storage facilities.
(2) The stormwater discharge point from a property shall not be changed without approval of the Public Service Director or his designee.
(3) The property owner shall submit to the Director all information required to demonstrate that the rate of stormwater discharge will meet the requirements as contained.
(4) The property owner shall be responsible to not change the stormwater drainage system on the property in any way that will cause damage or flooding to upstream or downstream properties.
(5) Emergency flood channels shall be designed as approved by the Director to convey excess stormwater when storms greater than the design storm occur.
(6) Stormwater shall not be discharged from any property to the surface of any City street, except for roof drains. Roof drains may discharge onto a City street when no alternative is available and when approved by the Director.
(7) Single family residential drainage permits are not required in instances of driveway culvert replacement, however, in all instances the owner(s) must contact the Director or his designee prior to said replacement and shall be done at the expense of the owner. Replacement of said culverts shall meet the requirements of Section 928.03(b) for size and type.
