(a) Designation Criteria. In considering the designation of any area, property or site in the City as a preservation district or landmark, due to historical significance, the Historic Preservation Board shall apply the following criteria:
(1) The character, interest or value of the area, property or site as part of the development, heritage or cultural characteristics of the City, the State or the United States.
(2) The location as a site of a significant prehistoric or historic event.
(3) The identification with a person or person who significantly contributed to the culture and development of the City.
(4) The exemplification by the area, property or site of the cultural, economic, social or historic heritage of the City.
(5) The embodiment of distinguishing characteristics of an architectural type or specimen.
(6) Identification as the work of an architect or notable builder whose individual work has influenced the development of the City.
(7) The embodiment of elements of architectural design, detail, materials or craftsmanship which represent architecture of significant character, charm or grandeur.
(8) A unique location or singular physical characteristics representing an established and familiar visual feature of a neighborhood or of the City.
(9) The portrayal of the environment of a group of people in an era of history characterized by a distinctive architectural style.
(10) Where applicable, and where they exist, design standards established for individual districts shall receive overriding consideration, that is, Brighton, Putnam, McIntire Terrace and Downtown.
(b) Procedure for Establishing Future Preservation Districts and Landmarks.
(1) When a proposal to establish a preservation district or to designate an individual property or site as a landmark for protection is received by or initiated by the Historic Preservation Board, the owner or owners shall be notified by the Board with staff assistance from the City Department of Community Development, and the owner's written comments requested.
(2) The Board shall consider the proposal in terms of the criteria provided in the previous section and according to applicable district standards and make a recommendation to the City Planning Commission.
(3) The City Planning Commission shall notify the affected owner or owners as per Chapter 1113
of the Planning and Zoning Code via ten-day written notice within 200 feet of the affected area and within the affected area, and shall review the proposal and the recommendation of the Board in terms of the effect of the designated area on the surrounding area and the projected development of the community, and shall make a recommendation to Council.
(4) Council shall give due notice to the affected owner or owners as per the Ohio Revised Code rezoning requests and give due consideration to the findings and recommendations of the Historic Preservation Board and the City Planning Commission in making its determination with respect to the proposed designation of an area, property or site as a landmark or an additional preservation district, and shall act in accordance with Historic Overlay District (HO) in the Zoning Code. Council action shall be in the form of an ordinance.
(5) After a decision by Council, the Board shall notify any owner or any person having a legal or equitable interest in such property of the decision by Council. All affected City departments, boards and commissions shall be notified.
