149.09 ORDER OF DISPOSITION.
No order or authorization by the Commission to destroy or otherwise dispose of any records shall be valid unless it is reduced to writing and signed by the members voting in the affirmative. When municipal records have been approved for disposal, a list of such records shall be sent to the Auditor of State. If he disapproves of the action by the Commission, in whole or in part, he shall so inform the Commission within a period of sixty days and these records shall not be destroyed. Before public records are disposed of, the Ohio Historical Society shall be informed and be given the opportunity for a period of sixty days to select for its custody such public records as it considers to be of continuing historical value.
If neither the Auditor of State nor the Ohio Historical Society requests the records, they shall be turned over to the Board of Control to be destroyed or sold for salvage.
The Commission’s written authorization is sufficient authority to any person having custody of records for the transfer thereof to the Auditor of State or the Ohio Historical Society or to the Board of Control.
