143.03 ELIGIBILITY LISTS FOR ORIGINAL APPOINTMENTS.
   (a)   The procedures set forth in Ohio R.C. 124.26(A) regarding the establishment of the eligibility list for original appointment to the City Fire Department are hereby altered pursuant to Ohio R.C. 124.90(B) as such alterations are necessary for the City, a Municipal Corporation, to comply with the Federal laws concerning discrimination in employment within the City Fire Department.

   (b)   The procedures set forth in Ohio R.C. 124.26(A) shall be altered as follows:
      (1)   The applicants on the present eligibility list for original appointment to the Youngstown Fire Department shall be divided into three separate eligibility lists based upon each individual applicant's rank on the present eligibility list:
         A.   A majority list (that is, all Caucasian applicants);
         B.   A minority list (that is, all Black, American Indian, Asian, Hispanic, etc., applicants); and
         C.   A female list (that is, all female applicants).
      (2)   Any future original appointments to the Youngstown Fire Department shall be made from the three newly established eligibility lists in groups of either three, six or nine simultaneous appointments.
         A.   If three appointments are to be made, then two applicants shall be selected from the majority list and one applicant shall be selected from either the minority list or the female list on an alternating basis beginning with the female list.
         B.   If six appointments are to be made, then four applicants shall be selected from the majority list, one applicant shall be selected from the minority list and one applicant shall be selected from the female list.
         C.   If nine appointments are to be made, then six applicants shall be selected from the majority list, two applicants shall be selected from the minority list and one applicant shall be selected from the female list.
         D.   If there is not a sufficient number of qualified applicants on the female list for appointment pursuant to the foregoing provisions, then an applicant shall be selected from the minority list to fill the appointment from the female list.
   (c)   The selection of the individuals from each of the three eligibility lists shall be made in accordance with Ohio R.C. 124.27
   (d)   For simultaneous appointments made pursuant to the foregoing provisions, the seniority of each individual shall be determined in order of the individual scores achieved on the examination without regard to the eligibility list from which the individual was selected.
   (e)   The foregoing alterations to Ohio R.C. 124.26(A) shall apply to each examination given for original appointment to the Youngstown Fire Department until December 31, 1995 or until the level of nonmajority personnel at the rank of firefighter has reached twenty-five percent (25%) of the total personnel at such rank whichever event occurs first.
