155.01 PURPOSE.
(a) This chapter establishes regulations necessary to ensure that Youngstown will continue to realize the benefits provided by its urban forest. The provisions of this ordinance are enacted to:
(1) Delegate the authority and for managing public trees;
(2) Create a Shade Tree and Beautification Committee;
(3) Establish practices governing the planting and maintenance of and on public property; and
(4) Provide for the emergency removal of trees on private property that are affecting public rights of way (e.g., sidewalks, streets, etc.).
(b) This chapter shall also repeal the previously enacted but legally unenforceable Shade Tree Commission enacted under Chapter 155 of the Youngstown City Ordinances.
(c) This chapter shall also amend Section 1749.01 of the Codified Ordinances, which currently specifically excludes "trees" as being a public nuisance.
