521.16 ENVIRONMENTAL SANITATION ENTERPRISE FUND.
   (a)    The City of Youngstown hereby establishes the Environmental Sanitation Enterprise Fund into which shall be deposited the fees the City receives from residential garbage collection and from the removal of trash, refuse, demolition debris and other waste materials, including any fees the City collects for abating dangerous property conditions by removal of insecure, unsafe or structurally defective vacant residential buildings under Ohio Revised Code Sections 715.26 and 715.261 and other public nuisances.
   (b)    The City may use the funds on deposit in the Environmental Sanitation Enterprise Fund to pay costs the City incurs in connection with residential garbage collection and the removal of trash, refuse, demolition debris and other waste materials, including, but not limited to the City's recycling program, removal of refuse in or around residential properties caused by high winds, fires or explosions resulting in hazardous conditions for City residents, and the City's removal of insecure, unsafe or structurally defective vacant residential buildings under Ohio Revised Code Sections 715.26 and 715.261 and other public nuisances. Costs payable from the Environmental Sanitation Enterprise Fund for these purposes include the purchase, maintenance and shelter of necessary equipment and vehicles, including debt service and financing costs related thereto, the cost or allocated portion of the cost of City employees involved in these activities, and out-of-pocket costs incurred for these activities.
   (c)    The provisions of this ordinance shall expire on December 31, 2025 unless City Council acts to renew this ordinance.
   (d)    The Youngstown City Council finds and determines that all formal actions of this Council and of any of its committees concerning and relating to the passage of this Ordinance were taken in an open meeting and that all deliberations of this Council and of any committees that resulted in those formal actions were held, in meetings open to the public, in compliance with law.
