523.02 RESTRICTIONS ON SMOKING IN CITY BUILDING AND VEHICLES.
(a) Smoking Prohibited/Buildings and Vehicles. Smoking or the possession of lighted smoking material in any building or portion thereof, including but not limited to, all levels of parking facilities except unenclosed levels, skywalks, and entryways owned, leased or controlled by the City of Youngstown. This prohibition is applicable to the public at large and employees of the City of Youngstown.
(b) Smoking Prohibited/Entrance and Exit. Smoking is prohibited in our buildings and areas that are adjacent to the ingress and egress of the buildings. As such, smoking is prohibited within twenty (20) feet of all entrances and exits to the buildings. No one is to be smoking immediately outside of any door into the building. Receptacles placed at the entrances are placed there for visitors and others as they are coming into the building and are not meant to represent designated smoking areas.
(c) Exceptions. Notwithstanding the provisions of subsection (a) of this section, the Fire Chief and Health Commissioner shall designate permitted smoking areas in all City owned, leased or controlled facilities if feasible. Smoking areas will not be designated in buildings without proper ventilation systems. In this situation, smoking will be prohibited.
(d) Whoever violates subsection (a) of this section shall be fined as follows:
$25.00 for the first offense;
$50.00 for the second offense;
$100.00 for the third offense.
