1719.05 ICE CREAM.
(a) Any person engaging in ice cream manufacturing, for wholesale or retail, shall obtain a permit from the Health Department to conduct such business and shall comply with all conditions of the City and State Sanitary Codes. All permits shall expire December 31 of the year for which issued. A separate permit is required for each place of business.
(b) All rooms or plants shall have two square feet of window surface, exposed to natural light, unobstructed for ten feet in any direction for each ten square feet of floor space.
(c) The floors of all workrooms shall be impermeable and made of concrete or tile laid in concrete or of other suitable nonabsorbent material which can be flushed and washed clean with water. Floors shall be sloped to one or more drains which shall be properly connected to a sewer system.
(d) Ice cream plants shall be located to insure proper shelter and drainage. Grounds shall be kept clean and no refuse shall be allowed to accumulate around or under the platforms.
(e) No basement shall be used as an ice cream plant unless approved by the Health Department.
(f) No person shall reside or sleep in an ice cream plant.
(g) No animals shall be stabled or kept in an ice cream plant.
(h) Every utensil, container, apparatus or tool used in preparing, manufacturing, transporting or storing ice cream for sale shall be wholly of stainless steel or other nonabsorbent and noncorrosive material and if seamed shall be flushed smooth.
(i) Ice cream plants shall be equipped with facilities for supplying and using an adequate amount of hot water and live steam for cleansing and sterilizing purposes.
(j) All creamery and condensory operators, ice cream manufacturers, and all other dealers in milk and milk products and their customers shall cleanse all receptacles used in shipping milk, milk products, cream or ice cream as soon as they are emptied and shall be stored in such manner as to prevent contamination.
(k) No person shall use any vessel used in the manufacture and sale of ice cream for any other purpose.
(l) Every vat, can, tank, pipe and every other utensil, container and tool used in preparation and manufacture of ice cream for sale shall be thoroughly cleaned and sterilized in a manner approved by the Health Commissioner.
(m) Pipe lines and valves shall be types to be readily disconnected and taken apart.
(n) The sale of ice cream cones or ice cream in bulk or in any other form than the original package is prohibited from any wagon, pushcart or any other vehicle in any park, street, alley or other thoroughfare within the City.
(o) No person shall refreeze any ice cream, sell or offer for sale any ice cream that has been refrozen.
(p) All work rooms shall be free from contamination and debris of every kind, including unused tools, utensils and apparatus. All such rooms shall be well lighted and ventilated. Mixing rooms shall be kept free from any materials except such as are used in the manufacture of ice cream.
(q) No person shall prepare, manufacture, sell, keep for sale, deliver, suffer or permit to be prepared, manufactured, sold or kept for sale or delivery, any ice cream, sherbet or ices, frozen custard or similar products which are falsely labeled, branded or misrepresented in any way or ice cream which contains glucose, starch, cottonseed oil, corn oil, gelatine in more than one-half of one percent (.5%) or inferior substances or less than ten percent (10%) of butterfat, or which does not conform to standards set in Ohio R.C. 3717.13 and 3717.51 et seq.
(r) All ice cream mixes shall conform to regulations governing the milk production.
(s) The entire mix without flavor or color shall be pasteurized.
(t) All fruits, nuts, egg products, flavors, color, sugars and stabilizers shall be wholesome and comply with State and federal food laws and regulations.
(u) Approved refrigeration facilities shall be provided for the safe keeping and storage of all ice cream, ice cream mix, frozen custard, frozen custard mix or other similar frozen products. (1967 Code §112.16)
