1719.02 PROHIBITED SALES.

   No person shall within the City, produce, sell, offer or expose for sale, or have in possession with intent to sell or give away, any milk or milk product which is adulterated, misbranded or ungraded. No person, elsewhere than in a private home, shall possess any adulterated, misbranded or ungraded milk or milk products. In an emergency, the sale of ungraded milk or milk products may be authorized by the Health Commissioner upon the approval of the Ohio Department of Health, in which case the milk products shall be labeled "ungraded."

   Adulterated, misbranded and/or improperly labeled ungraded milk or milk products may be impounded by the Health Commissioner and disposed of in a manner approved by the Commissioner. (1967 Code §112.02)
